(“Engineer” ADDRESS: 710 Hesters Crossing, Suite 150, Round Rock, TX 78681 PROJECT: CR 112 from CR 117 to CR 110 This Supplemental Contract No. 3 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the “City” and HDR Engineering, Inc., hereinafter called the “Engineer.” WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the “Contract,” on the 9th day of January, 2020 for the CR 112 from CR 117 to CR 110 Project in the amount of $468,491.63; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on February 10, 2022 to amend the scope of services and to increase the compensation by $641,626.89 to a total of $1,110,118.52; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on October, 10, 2024 to amend the scope of services and to increase the compensation by $154,324.00 to a total of $1,264,442.52; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $92,697.00 to a total of $1,357.139.52; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. II. Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $92,697.00 the lump sum amount payable under the Contract for a total of $1,357.139.52, as shown by the attached Addendum to Exhibit D. Project Length: 6,825 feet (1.293 Miles) Project Statement: The roadway improvements for CR 112 from CR 117 to CR 110 are to widen this 1.293-mile section from a two-lane rural roadway to six-lane divided arterial roadway and add pedestrian facilities per the approved schematic developed in the Preliminary Engineering Phase. The work to be performed by HDR Engineering, Inc. (ENGINEER) for this Supplemental Contract No. 3 shall consist of a Conditional Letter of Map Revision (CLOMR) for FEMA approval for the McNutt Creek crossing at County Road 112 and revisions to Culvert A-1 to keep the limits of impacts on the Ordinary High Water Mark (OHWM) under 0.1 acres. The limits of the study will be on the McNutt Creek from downstream of SCS Dam 16 to the project termination just upstream of Paloma Lake Blvd (Approximately 3,000 LF). The detailed scope of services for this work is further described below. TASK I: PROJECT MANAGEMENT A.Managing Contracted Services (Project Management) a.Additional Project Coordination Meetings with CITY: The ENGINEER will coordinate with the CITY to complete the PS&E for the project. The ENGINEER will prepare for and attend coordination meetings with the CITY to discuss project progress, planned activities, key issues or items requiring decision or approval by the City. The ENGINEER shall prepare meeting minutes for all meetings and will distribute to staff for approval and record keeping. b.Coordinate with CITY’s consultant for Kenney Fort Boulevard: The ENGINEER will coordinate with the designer of the Kenney Fort project, currently in the design development phase. This includes the revisions to Structure A-1 to minimize the impacts to the OHWM and remain under the 0.1 acres threshold. c.Quality Assurance / Quality Control: The ENGINEER will provide quality control of identified documents prior to each defined design submittal (Final) following established quality assurance processes. City of Round Rock CR 112 from CR 117 to CR 110 Page 2 of 4 Exhibit B Supplemental No. 3 TASK II: ROADWAY DESIGN The following design changes have been requested by the CITY to minimize the impacts to the OHWM and remain under the 0.1 acres threshold. Additional grading at the outfall will be required to stay within the 0.1 acres threshold. A. Detail Grading: Detail grading shall be revised to reflect the latest Culvert A-1 design on Kenney Fort Blvd and CR 112. B. Plans Production Revision: The ENGINEER shall revise the PS&E plans as necessary to reflect the latest Culvert A-1 design. C. Update Quantity Summary Sheets: Update summary sheets showing item description, item unit, and item quantity for roadway bid items. TASK III: DRAINAGE DESIGN A. Conditional Letter of Map Revision (CLOMR) for McNutt Creek: · Update hydrologic model to meet FEMA standards for existing conditions 10%, 4%, 2%, 1%, 0.2% and ultimate conditions 1% annual exceedance events and provide peak flow data for the Duplicate Effective conditions. · Update hydraulic model to meet FEMA standards for the 10%, 4%, 2%, 1%, and 0.2% annual exceedance events under existing development conditions and provide peak flow data for the following conditions: · Duplicate Effective · Corrected Effective · Proposed Conditions · Perform a FEMA floodway encroachment analysis · Prepare revised floodplain mapping to meet FEMA standards within study limits using the best available LiDAR topography supplemented with field survey and design to reflect hydraulic modeling revisions. Revisions will include: o 1% annual chance Existing Conditions floodplain boundaries o Update 1% annual chance floodway boundaries o Base Flood Elevations (BFE’s) and lettered cross sections o Streamlines, cross section layout · Prepare certified topographic work map and annotated FIRM exhibits in conformance with FEMA mapping standards to depict mapping changes. Geospatial documentation will be included in the CLOMR package. · Update 100% drainage report for CLOMR submittal. City of Round Rock CR 112 from CR 117 to CR 110 Page 3 of 4 Exhibit B Supplemental No. 3 · Prepare FEMA MT-2 Forms and additional explanations as required. Endangered Species Act (ESA) documentation as required in FEMA MT-2 Form 2 will be completed by CoSA and provided to HDR to include with CLOMR Package. · Provide example public notice letter, list of impacted properties, and key map. CoRR will be responsible for publishing required notifications. · Prepare CLOMR package for CoRR review and Floodplain Administrator approval. Development of FIS Profiles for final mapping are not included in this scope of work. · Submit CLOMR package to FEMA within 10 working days of receiving the CoRR Floodplain Administrator’s approval. Fee for FEMA’s CLOMR Technical Review fee is not included in this scope of work. · Provide Community Notification Letter to CoRR for review/approval and submittal to FEMA. B. Revision to Culvert A-1 under CR 112 and Kenney Fort Blvd: The Structure A1 alignment will be redesigned and shortened to mitigate environmental permitting requirements for the CR 112 roadway project. In addition to plan sheet updates, hydraulic models will be updated to match the revised Structure A1 alignment Plans: · Update Structure A1 Plan and Profile Sheet with revised alignment and hydraulic results · Update storm drain tie in elevations to Structure A1 · Update Structure A1 hydraulic calculation data sheets · Update proposed grading at upstream and downstream headwalls. Hydraulic Model: · Update proposed Structure A1 HEC-RAS model with revised alignment Drainage Report: · Update reported water surface elevation (WSE) in report text · Update reported WSE in Appendix C · Update Appendix A Exhibits with revised model information TASK IV: ROW SURVEY A. Right-Of-Entry (ROE) Coordination: The ENGINEER shall attempt to obtain ROE for up to five (5) potentially impacted properties for the purpose of completing the surveying, upon approval from the City of Round Rock. Prepare and mail the ROE letters per the City’s standard. The Surveyor anticipates that the City will facilitate the resolution of any refusals to grant ROE and/or communications with landowners who are hostile with respect to the completion of this City of Round Rock CR 112 from CR 117 to CR 110 Page 4 of 4 Exhibit B Supplemental No. 3 scope of services. The Surveyor will document any interactions with landowners while performing the work. B. Boundary Survey: a. The ENGINEER will perform sufficient research of the affected properties to reconstruct the existing boundary lines from record information. b. The ENGINEER will perform sufficient survey field boundary surveying for the project site to locate the record boundaries developed in item 1 on the ground. c. The ENGINEER will perform sufficient boundary analysis of the gathered field work to depict the reconstructed boundaries. d. Deliverables will include a Microstation 2D file showing the right-of-way and adjoiner boundary lines. C. Parcel Survey: a. The ENGINEER shall set/recover verify existing horizontal. The values will be relative to NAD 83 Texas State Plane Coordinates, Central Zone (scaled to surface values). b. The ENGINEER will perform sufficient field and office tasks to generate metes and bounds description with survey plat for up to five (5) acquisition parcels on the described tracts. c. The ENGINEER will find or set property corners monumenting the boundary of the parcel accordance with the rules and regulations of the Texas Board of Professional Engineers and Land Surveyors. d. The ENGINEER will review title commitments provided by Client for each parcel, if the title commitments is provided prior to the signing/sealing of the easement. e. Review of a title commitment after the signing/sealing of the easement will be considered a revision and an additional service to this proposal f. The specific scope of work is developed from email instructions dated September 12th & 23rd, October 1st & 7th, 2024.
