Hervol; In the County Court at Law No. 5, Williamson County, Texas Dear Mr. Hervol: Following up on our recent correspondence, this letter is a Rule 11 Settlement Agreement between CITY OF ROUND ROCK, TEXAS ("City") and HENRY J. HEVOL ("Owner" and together with City the "Parties") in connection with the project identified herein and the permanent and temporary easements to be acquired as part of City's waterline utility facilities project(the"Project"). The terms of this Agreement and the settlement reached are as follows: 1. The City agrees to pay FOUR THOUSAND FOUR HUNDRED NINETEEN AND 00/100 DOLLARS ($4,419.00) in complete settlement of any and all claims which have been or which could have been made as a result of the events giving rise to the filing of the live petition in this matter, including but not limited to, the compensation for the City's acquisition described in Exhibit "A" attached hereto (the "Property"), any and all real property improvements located thereon, damages to the remainder, if any, costs to cure, if any, as well as any other claims related to this case. Owner acknowledges that City previously deposited FOUR THOUSAND FOUR HUNDRED NINETEEN AND 00/100 DOLLARS ($4,419.00) into the registry of the Court on or about April 19, 2024, leaving a balance of ZERO AND 00/100 DOLLARS owed to Owner. 2. Notwithstanding the foregoing, the Parties agree to file an agreed final judgment, in the amount of FOUR THOUSAND FOUR HUNDRED NINETEEN AND 00/100 DOLLARS ($4,419.00), to dismiss this case. Thereafter, each party agrees to pay their own fees and costs. Said agreed final judgment shall incorporate by reference the provisions of this Rule 11 Settlement Agreement. 6/11'225--D 37 3. As an obligation which shall survive dismissal of this lawsuit, the City agrees that as part of the proposed Red Bud Lane roadway improvements upon the Property, it shall at its sole expense cause the existing driveways to Owner's remaining property to be reconstructed in the locations and according to the design and specifications as shown in the plan sheets attached hereto as Exhibit "B" unless otherwise agreed between Owner and City in advance. By execution of this Rule 11 Agreement, Owner grants City, its contractors, and agents the temporary right to enter the remaining property of Owner only in the limited locations and duration reasonably required to carry out the obligations of this paragraph. If this letter correctly sets forth the terms of our agreement and the settlement reached between City and Owner, please so indicate by having the appropriate persons execute this letter in the space indicated below and return it to my attention. It appears to the Court that it has jurisdiction over this matter, the parties have agreed to all provisions contained within this Agreed Final Judgment,and the parties desire to resolve this lawsuit, IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that fee title in and to approximately 400 square feet (Parcel 11) of land in Williamson County, Texas, said property being more particularly described by metes and bounds in Exhibit "A" attached hereto and incorporated herein for all purposes, and additional rights or encumbrances as further described in Plaintiff's Original Petition, filed among the papers of this cause on or about November 1, 2023; excluding all the oil, gas, and sulfur which can be removed from beneath said real property, without any right whatever remaining to the owner of such oil, gas, and sulfur of ingress or egress from the surface of said real property for the purpose of exploring, developing, or mining of the same,be vested in CITY OF ROUND ROCK,TEXAS, and its assigns for the purpose of constructing, reconstructing, realigning, widening, and/or maintaining improvements to the Red Bud Lane roadway improvement project, and to perform associated public use and purposes. It is further ORDERED that in complete satisfaction of any and all claims which have been made or which could have been made in this litigation, including both the property to be acquired and any damages to any remaining property of HENRY J. HERVOL ("CONDEMNEE"), that Condemnee shall recover from Condemnor the total sum of FOUR THOUSAND FOUR HUNDRED NINETEEN AND 00/100 DOLLARS ($4,419.00). The parties agree FOUR THOUSAND FOUR HUNDRED NINETEEN AND 00/100 DOLLARS ($4,419.00) was previously deposited into the Court's registry on April 19, 2024,pursuant to the written Award of Special Commissioners filed on February 5, 2024, leaving a balance due of ZERO Dollars. Notwithstanding the foregoing, the parties further agree that the obligations set forth in the Rule 11 Settlement Agreement filed amongst the papers of this cause are incorporated by reference herein and shall survive the dismissal of this lawsuit. It is further ORDERED that all costs be assessed against Condemnor.
