Construction's decision to deduct the Chlorine Contact Basin (CCB)work from the contract
associated with PCO No. 24-1207-01 for the Brushy Creek East Wastewater Treatment Plant
Tertiary Filters Project.
The City accepts this deduction and wants to proceed to resolve this matter collaboratively.
As part of this acceptance, we request that a corresponding credit be issued to the contract
value to reflect the removal of the CCB related scope of work. Please provide the revised
contract total and associated documentation for our review and approval. This should be
submitted through Procore under the current change event.

Dear Mr. Hutton:
Thank you for your response. After reviewing your comments, Keeley has made some adjustments
to PCO No. 24-1207-02 JB3 Additional Bypass & Repair.
• Keeley has removed the requested additional days.
• Bypass pumping fuel, we have reduced the number of gallons and calculate fuel usage for a
25 MGD bypass to help reduce some of the costs, Keeley will keep track of the fuel usage
and reconcile cost after completion of work.
We appreciate sharing how Thalle intended to execute the repairs at JB3. After further
investigation, having to perform an initial and final bypass like Thalle's will also require maintaining
the pumps on site until work has been completed. Unfortunately, Mersino's rates are per week,
and it will also require keeping the pumps on site until work has been completed.
Keeley will perform this additional scope of work during the day shift and will have an after hours
shifts for pump watch.
Another point that we would like to clarify is that due to the 24in pipe still being connected
through JB3 structure, Keeley would have to dewater the 24in when we separate the pipe from the
structure.

Dear Ms. Palacios:
Thank you for submitting Change Order Proposal PCO#24-1207-02 for the JB3 bypass
pumping and repair. While we acknowledge the need for this work, we have concern
regarding the requested three additional days, as it was not anticipated that this work would
impact critical path due to delay in FRP pipes'arrival. Given the scope and the nature of the
tasks involved, we ask that you revisit the schedule and provide further justification for any
extra time
Additionally, we have some questions about the cost breakdown proposed; half of the cost is
for Mersino's services, the proposal appears to suggest that a 24-hour bypass pumping
activity will be performed. Can you confirm if this is the case?When Thalle was exploring this
corrective action, it was determined that a safer approach was not to permanently bypass
pump, but to only bypass pump for an initial draw down period to be able to fix form work or
other hydraulic seal on the inside of the junction box. Then once the repair has been
completed another pump down bypass would be performed to remove anything inside the
junction box and inspect the work. Would this approach significantly reduce the proposal
amount from Mersino? Furthermore, the$35,280 diesel cost assumes a full week of bypass
pumping. As discussed in our last construction progress meeting on March 13, 2025, we
request that Keeley explore options to mitigate costs, such as tracking fuel usage and
reconciling actual costs after completion. We request Keeley review ways to mitigate costs
such as the suggested approach while safely performing the work. It is not clear where the
costs for the materials to repair the 24" core drilled section are within this proposal, it is
understood Keeley will be working to establish a new connection for the 84" and these
material costs could be part of the contract work? If this is the case, please state this for
clarity in the proposal.
We appreciate your cooperation in reviewing these concerns and look forward to receiving
your revised proposal. Please let us know if you need any additional information.

additional days. The addition of these fasteners will require to drill (88) holes through the steel
plates and concrete, (1 hole every 5ft, North and South side of each channel). After installing all
Checkered Plates, we will install (88) Fasteners. The original scope of work is to cast in place the
steel embeds and place the checkered plates on top.

Tee and Gate Valves on NPW Service
PCM-02
During the review of dient comments on the 60% design submittal for the Brushy Creek East Plant 40 MGD
Expansion, KFA identified an opportunity to incorporate work into the Tertiary Filters Project that would optimize
construction sequencing, reduce costs, and minimize plant shutdowns. The proposed modification involves
adjusting the installation of the 12"Non-Potable Water(NPW)line to avoid redundant work and unnecessary
shutdowns.
The 60%review plans of the 40 MGD Expansion project include a 12"NPW line that connects to an existing 8"NPW
line using a 12'x8"reducer and a 12'x8"MJ Tee during a shutdown. The Tertiary Filters Project already includes
installing a 12"NPW line that also connects to the same 8"NPW line in the same manner. Instead of executing two
separate tie-ins requiring multiple shutdowns, this PCM proposes incorporating the installation of an 8'x8"MJ Tee
and two 8"gate valves as part of the Tertiary Filters Project, see attached plan.
The proposed change is expected to streamline construction efforts by eliminating the need for a second shutdown
for the same work area during the 40 MGD expansion construction.
The components of the PCM shall include:
1. Installation of an 8"x8"Mi Tee in place of the proposed 12"x8"Mi Tee.
2. Installation of two 8"gate valves, one on the north side and one on the east side of the tee.
3. Coordination to ensure the work is completed without affecting any critical path activities.
