Texas Government Code Section 2269.056(a) requires the "governing body of a governmental entity that considers a
construction contract using a method authorized by this chapter other than competitive bidding must, before advertising,
determine which method provides the best value for the governmental entity.
Pursuant to Section 2269.053,the Round Rock City Council delegated its authority to determine whether an alternative
project delivery method provides the best value to the municipality to the City Manager by Resolution No. 2024-274.
The City of Round Rock desires to use an alternative method other than competitive bidding when entering into a
contract for the Cycle 4 - Basins 1 and 2 Wastewater Main Rehabi ("Project").
Chapter 2269 requires that a project-by-project determination be made as to what method provides the best value for
the governmental entity in relation to a particular project.
The City Manager has determined that the Project would be best served by utilizing the Competitive Sealed Proposal
method.

The City is required to evaluate the wastewater system inside the Edwards Aquifer recharge zone every
five years to comply with the Texas Commission on Environmental Quality requirements.The elimination
of defects inside the Edwards Aquifer recharge zone will not only help to protect the Edwards Aquifer but
will reduce inflow and infiltration entering the City's wastewater collection system,thereby reducing the
City's treatment cost.Approximately 60%of the City is located over the Edwards Aquifer.The City has
divided this area up into five basins with numerous sub-basins.The City has recently completed the
inspection and design to rehabilitate the defects within basins one and two.
This request is for the approval to use a Competitive Sealed Proposal (CSP) procurement method.Aspects
of the project will require methodical and careful coordination with nearby schools, Georgetown
Railroad,Texas Crushed Stone, and The Transportation Division to perform the rehabilitation work at the
optimum time with proper traffic control and bypass pumping. Parts of the rehabilitation work will occur
along Old Settlers Boulevard and Settlement Drive. Both have deep wastewater pipes (approximately 20
feet deep),which require additional precautions. Due to the complex nature of the project,the Public
Works Department requests approval to use CSP.The CSP method will allow the project team to evaluate
contractors on qualifications and cost, ensuring the selection of a qualified contractor to perform the
work and provide the best overall value to the City of Round Rock.
