Sandre Texas Government Code Section 2269.056(a) requires the "governing body of a governmental entity that considers a construction contract using a method authorized by this chapter other than competitive bidding must, before advertising, determine which method provides the best value for the governmental entity. Pursuant to Section 2269.053, the Round Rock City Council delegated its authority to determine whether an alternative project delivery method provides the best value to the municipality to the City Manager by Resolution No. 2024-274. The City of Round Rock desires to use an alternative method other than competitive bidding when entering into a contract for the Clay Madsen Recreation Center Remodel Project ("Project"). Chapter 2269 requires that a project-by-project determination be made as to what method provides the best value for the governmental entity in relation to a particular project. The City Manager has determined that the Project would be best served by utilizing the Construction Manager-At-Risk method. Sandre Building Construction Division Alternate Delivery Method Analysis Date: 4/29/2025 Project: Clay Madsen Recreation Center Remodel and Expansion Delivery Method: Construction Manager at Risk Analysis Pro's: Clay Madsen Recreation Center may be best delivered as a CMAR. The scope is undefined but the total project budget is set at $20 million. If the facility is to remain operational during the construction of the project, the CM can work with A/E team to help identify work sequence packaging. The CM pre-construction phase can help provide cost information, assist in material selections, design assist, and constructibility review. With CMAR, the City has more oversight in the selection of quality subcontractors, encumbered contingency within the GMP and the Contractor is at risk to complete the project, within the guaranteed maximum price. Using CMAR could be a time savings to the overall project schedule, as the project could be bid at less than 100% construction documents. Analysis Con's: Fair compensation for contractor(s) staffing requirements, general conditions, and general requirements. Possible higher construction costs for quality subcontractors verses and low bid project. Risk: currently tracking escalation, material price increases, tariffs, and land purchase. Building risks include utilities, envelope, humidity, and aging infrastructure. Expansion risk include price per square foot, scope creep, and available build-able space.
