This Supplemental Contract No. 5 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Freese and Nichols, Inc.,
hereinafter called the "Engineer."
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the"Contract,"on the 24th day of March, 2022 for the Chisholm Trail South Improvements
(Old Town) Project in the amount of$389,055.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on October, 14, 2022
to amend the Contract to modify the provisions for the scope of services, work schedule, and fee
schedule; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on June 8, 2023 to
amend the scope of services and to increase the compensation by $584,885.00 to a total of
$973,940.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on March 8, 2024 to
amend the scope of services and to increase the compensation by $49,679.00 to a total of
$1,023,619.00; and
WHEREAS,the City and Engineer executed Supplemental Contract No.4 on November 18,2024
to amend the scope of services and to increase the compensation by $49,934.00 to a total of
$1,073,553.00; and
WHEREAS,it has become necessary to amend the Contract to modify the provisions for the scope
of services and to increase the compensation by $145,470.00 to a total of$1,219,023.00;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is
amended as follows:

I.
Article 1, City Services and Exhibit A, City Services shall be amended as set forth in the attached
Addendum To Exhibit A.
II.
Article 2,Engineering Services and Exhibit B,Engineering Services shall be amended as set forth
in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth
in the attached Addendum to Exhibit C.
III.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$145,470.00 the lump sum amount payable under the Contract for a total of $1,219,023.00, as
shown by the attached Addendum to Exhibit D.

ADDENDUM TO EXHIBIT A
City Services
The CITY OF ROUND ROCK ("CITY") is proposing to develop a 0.44 mi segment of Chisholm Trail Road
between Sam Bass Road and RM 620. The work to be performed under this work authorization by FREESE
AND NICHOLS, INC. ("CONSULTANT") will consist of the preliminary engineering and modeling to assess the
Brushy Creek floodplain impacts and obtain environmental clearance for the proposed upstream culvert
extension at the low water crossing. Additionally, design will be prepared to incorporate a sidewalk connection
from Sunset Dr to the existing Heritage Trail pedestrian bridge into the existing Chisholm Trail Road construction
contract.
City services will remain unchanged with this amendment.

ADDENDUM TO EXHIBIT B
Engineering Services
The CITY OF ROUND ROCK ("CITY") is proposing to develop a 0.44 mi segment of Chisholm Trail Road

AND NICHOLS, INC. ("CONSULTANT") will consist of the preliminary engineering and modeling to assess the

110.0 ROUTE AND DESIGN STUDIES
1. The CONSULTANT shall evaluate a culvert extension to provide pedestrian crossing on the west side of
Chisholm Trail Road over Brushy Creek, including preliminary coordination with the CITY Floodplain
Administrator(FPA)for conceptual buy-off.
2. The CONSULTANT shall coordinate with pedestrian rail manufacturers to identify and evaluate potential
products for project use.
120.0 SOCIAL/ECON/ENVIRON STUDIES
1. The CONSULTANT will complete additional coordination with the adjacent post office for the Chisholm Trail
South project and utility providers in preparation for construction activities. The CONSULTANT will prepare one
(1)additional exhibit for post office coordination.
2. Habitat Assessment and Ordinary High Water Mark (OHWM) Delineation
The CONSULTANT will conduct one (1) site visit of the proposed project area to gather necessary data and
photographs towards the development of a U.S. Army Corps of Engineers (USACE) permit application, including
a habitat assessment and delineation of the OHWM of Brushy Creek. The site visit and delineation will be used
to develop the Waters of the US (WOTUS) report and quantify the amount of fill below the OHWM.
Assumptions:
• The preliminary environmental evaluation will include a desktop-level review and one (1)field site visit of
potential environmental constraints and regulatory requirements.
3. USACE Permitting
Based on knowledge gained from Task 1, FNI will develop the appropriate permit application to be submitted to
the USACE for discharges of fill within WOTUS associated with construction of the project, which is a regulated
activity under Section 404 of the Clean Water Act.A Pre-application Meeting with the USACE is recommended
to discuss the project with a Corp project manager and establish a permitting approach. After a permitting
approach is confirmed by USACE, the CONSULTANT will begin work on the Nationwide Permit with a Pre-
construction Notification application package. The application package consists of several components,
including the following:
• ENG 6082 or 4345 Form—discloses the applicant's and project's information, such as project need and
purpose, project location, adjoining properties, etc.
• Representative Photographs—depicts the pre-project conditions.

• Waters of the US Delineation Report — identifies the presence and extent of regulated waters and
identifies the regulated fill discharges that would occur with the proposed project. GIS figures showing
the project extent and design components would be developed to accompany the report.
• Federally listed Species Habitat Assessment report—The CONSULTANT will prepare a threatened and
endangered species habitat assessment report to document the findings from the desktop review
including recommended effect determinations for each species. The draft report will be provided to the
City for review and comment.
• Plan and Profile Drawings — clear, concise, and simple drawings developed in the plan set by the
CONSULTANT will be included and will identify the regulated fill discharges associated with the project.
• Section 401 Water Quality Certification Checklist (for the Texas Commission on Environmental Quality)
—documents the proposed Best Management Plans (BMPs)during construction to maintain water quality
standards for demonstrating compliance with Section 401 of the Clean Water Act.
• Cultural Resource Evaluation — desktop survey for previously documented cultural resources in the
project area, for demonstrating compliance with Antiquities Code of Texas and Section 106 of the
National Historic Preservation Act.A letter documenting the cultural resource evaluation will be submitted
to the Texas Historic Commission (THC) for review by the State Historic Preservation Officer (SHPO).
The THC's concurrence regarding Antiquities Code of Texas and Section 106 of the National Historic
Preservation Act will be included with the USACE permit application.
Assumptions:
• The USACE would allow the project to be permitted under a Nationwide Permit (NWP) with a Pre-
Construction Notification (PCN). If the USACE requires the project to be permitted under a Letter of
Procedure (LOP) or Individual Permit (IP), then the effort to produce an LOP or IP application package
could be covered with a cost amendment as an additional service.
• The Section 404 permit application cannot be submitted to the USACE until concurrence from the THC
is received regarding Antiquities Code of Texas and Section 106 of the National Historic Preservation
Act.
• Presence/absence surveys for federally listed or proposed species will not be required. If required by the
USACE or USFWS, then this service could be covered with a cost amendment as an additional service.
• The USACE would not require any compensatory mitigation as a result of project impacts. If project
impacts require mitigation, those services could be covered with a cost amendment as an additional
service.
• The CONSULTANT will conduct a desktop investigation of cultural resources within 1 kilometer of the
project area. The results and findings of the desktop cultural resource investigation will be submitted in a
coordination letter to the THC. If an additional archeological survey is required by the THC for impacts to
historical and archeological resources, then additional services can be provided with a scope and cost
amendment.
4. Texas Commission on Environmental Quality(TCEQ) Edwards Aquifer Permitting
The CONSULTANT shall perform tasks related to compliance with Edwards Aquifer Protection Program
(EAPP), which is regulated by TCEQ and related to Section 401 Water Quality Certification. Compliance with
the EAPP is required for projects occurring within the Edwards Aquifer Recharge or Contributing Zones. The
property is located within the boundary of the Edwards Aquifer Recharge Zone. Due to the increase in
impervious cover for the Chisholm Trail Culvert project, a Water Pollution Abatement Plan (WPAP)will be
required by the Edwards Aquifer Protection Program. Because of the minor amount of impervious cover
proposed, the CONSULTANT assumes that a WPAP Exception Request can be utilized. The CONSULTANT
will coordinate with the TCEQ EAPP for an Exception Request for the project.

• A Geologic Assessment was performed for the Chisholm Trail South Improvements project in 2023 and
that the Geologic Assessment report is still applicable for the WPAP, if required.
5. Fish Recovery and Relocation
Since the project will require dewatering of the creek, coordination with the Texas Parks and Wildlife
Department(TPWD)to perform an aquatic resource recovery and relocation during dewatering of the
cofferdam structure will be required. The CONSULTANT will coordinate with TPWD to receive the necessary
permissions to perform the fish recovery and relocation. Access, safety, and schedule will be coordinated with
the CITY and construction contractor. The CONSULTANT will notify TPWD Kills and Spills Team (KAST)
biologist, Travis Tidwell, at least 72 hours prior to collecting and relocating organisms. Depending on the
project size, the survey will be conducted by qualified biologists with seine nets, dip nets, and a backpack
electrofishing device. The CONSULTANT will systematically search for and remove any live fish and mussels
observed within the project area. Fish, mussels, and other aquatic organisms will be identified, enumerated,
and representative photos will be taken of each species. A report will be drafted after the survey and will be
provided to the CITY for one round of review and comment. The report will be delivered to the CITY for review
and comments, and copies of the report will be sent to TPWD after final approval.
Assumptions:
• This task does not include the additional effort or coordination required if a state or federally proposed
or listed mussel species is observed within the survey area. This finding would result in a follow-up
survey effort and additional coordination with the U.S. Fish and Wildlife Service (USFWS)and TPWD.
• The CONSULTANT assumes that the fish relocation can be conducted with one (1)site visit to the
construction site once the dewatered area has been lowered to at least 1 foot. If additional site visits
are required due to dewatering issues, then those additional relocation efforts may result in a cost
amendment.

Designs)

145.0 PROJECT MANAGEMENT
1. Project Coordination Services will include the following:
• The CONSULTANT will meet with the CITY as needed. For the purpose of scoping, a maximum of
four(4) 1-hour virtual meetings, including agenda and meeting minute prep, are assumed with three
(3)attendees. The CONSULTANT will prepare and distribute meeting agendas twenty-four(24)hours
before the meeting. The CONSULTANT will prepare and distribute meeting minutes within three (3)
business days of each meeting.
• The CONSULTANT will attend a Comment Resolution Meeting after the exhibit submittal to discuss
review comments. For the purpose of scoping, a maximum of one (1) three (3) hour in-person
meeting, including travel time and agenda and meeting minute prep, are assumed with three (3)
attendees. The CONSULTANT will respond in writing to reviewer comments. Responses will include

explanations for any items in disagreement. The CONSULTANT will prepare and distribute meeting
minutes within three (3)business days of each meeting.
• The CONSULTANT shall coordinate with the CITY's utility and parks groups to assess the proposed
sidewalk connection and identify any potential conflicts.
2. Quality Assurance/Quality Control (QA/QC)Services will include the following:
• The CONSULTANT will perform QC measures for each deliverable.
• The CONSULTANT will complete QA checks throughout the project life cycle. QA documentation will
be made available to the CITY upon request.
3. Project Administration Services will include the following:
• Each month for the duration of the project in excess of the current project schedule, the
CONSULTANT will submit to the CITY its invoices for services completed and compensation due,
arranged by task.
• Each month for the duration of the project, and included with the submission of each invoice, the
CONSULTANT will submit a monthly report of the status of work performed through the end of the
previous month. The CONSULTANT will summarize decisions or agreements made and will outline
unresolved or pending issues requiring the CITY'S involvement or decision.
• The CONSULTANT will complete project administrative maintenance tasks and project set up.
160.0 ROADWAY DESIGN SERVICES
1. The CONSULTANT will revise the issued for bid Roadway plan sheets to incorporate the proposed sidewalk
connection and any associated changes to the roadway curb line and/or inlet throat extension.

161.0 DRAINAGE DESIGN SERVICES
The CONSULTANT shall provide hydraulic analysis and reporting for the extension of the Chisholm Trail box
culverts over Brushy Creek to accommodate pedestrian facilities on the west (upstream) side of the crossing.
The CONSULTANT will evaluate both the FEMA and Atlas 14 flow conditions and evaluate if a no-rise condition
can be met with the proposed improvements.
1. Existing Conditions Hydraulic Analysis
• The CONSULTANT will utilize the Brushy Creek FEMA Effective HEC-RAS model and best
available Atas 14 HEC-RAS model provided by Williamson County. It is assumed the FEMA
Effective model and Atlas 14 HEC-RAS model will be provided by the CITY.
• The Chisholm Trail bridge crossing and bounding cross-sections will be updated as necessary with
the project survey obtained as part of the Chisholm Trail Improvement project. The upstream
bounding cross-section will be adjusted if necessary to not conflict with the proposed culvert
extension.
• No other improvements or adjustments to the HEC-RAS models are expected.

• Two different models will be required. The FEMA Effective model with the effective FEMA flows and
the Atlas 14 model, recently developed by Williamson County. Both models will be updated with the
proposed Chisholm Trail culvert extension.
• In the Atlas 14 model, two conditions will be considered requiring two separate geometries. The first
condition will include the 42" tall pedestrian rail and will simulate the higher frequency storms (2-, 5-,
10-, 25-yr). The second condition will remove the pedestrian rail, which will break away via shear
pins, and simulate the lower frequency storms (50-, 100-, 500-yr).
• Proposed solutions will be developed, iterated, and modeled with the goal of reaching a no-rise
condition in the FEMA and Atlas 14 100-yr and a no adverse impact solution in the higher frequency
events.
• The model methods, approach, and results will be coordinated with the CITY FPA for agreement
before the Draft Drainage Report. For the purpose of scoping, two (2)four(4) hour in-person
meetings, including travel time and agenda and meeting minute prep is included for four(4)
attendees.
3. Reporting
The CONSULTANT will develop a Drainage Report, which documents the methods and assumptions used for
the hydraulic analysis. The report will document the general approach, iterations in the design, and the final
results and recommendations.

• Final Drainage Report
Assumptions:
• No hydrologic analysis will be performed — FEMA or Atlas 14 flows will be used and no hydrology is
required.
• No Conditional Letter of Map Revision (CLOMR) is required.
• PS&E document development shall be an additional service.
162.0 SIGNING AND PAVEMENT MARKINGS SERVICES
1. The CONSULTANT will revise the issued for bid signing and pavement marking plan sheets to incorporate
the proposed sidewalk connection.

163.1 TRAFFIC CONTROL PLAN DESIGN SERVICES
1. The CONSULTANT will revise the issued for bid Traffic Control Plan (TCP) to incorporate the
proposed sidewalk connection. The TCP will be revised in accordance with the most recent
version of the Texas Manual of Uniform Traffic Control devices (TMUTCD).

SCOPE OF WORK
EDGE shall provide hydraulic analysis and reporting for the extension of the Chisholm Trail box culverts
over Brushy Creek to accommodate pedestrian facilities on the west(upstream)side of the crossing.
EDGE will evaluate both the FEMA and Atlas 14 flow conditions and evaluate if a no-rise condition can
be met with the proposed improvements.
Task 1: Existing Conditions Hydraulic Analysis
• EDGE will utilize the Brushy Creek FEMA Effective HEC-RAS model and best available Atas 14
HEC-RAS model provided by Williamson County. It is assumed the FEMA Effective model and
Atlas 14 HEC-RAS model will be provided by the City.
• The Chisholm Trail bridge crossing and bounding cross-sections will be updated as necessary
with the project survey obtained as part of the Chisholm Trail Improvement project.The
upstream bounding cross-section will be adjusted if necessary to not conflict with the proposed
culvert extension.
• No other improvements or adjustments to the HEC-RAS models are expected.
Task 2: Proposed Conditions Hydraulic Analysis
• Two different models will be required.The FEMA Effective model with the effective FEMA flows
and the Atlas 14 model recently developed by Williamson County. Both models will be updated
with the proposed Chisholm Trail culvert extension.
• In the Atlas 14 model,two conditions will be considered requiring two separate geometries.The
first condition will include the 42"tall pedestrian rail and will simulate the higher frequency
storms(2-, 5-, 10-, 25-yr).The second condition will remove the pedestrian rail, which will break
away via shear pins,and simulate the lower frequency storms(50-, 100-,500-yr).
• Proposed solutions will be developed, iterated, and modeled with the goal of reaching a no-rise
condition in the FEMA and Atlas 14 100-yr and a no adverse impact solution in the higher
frequency events.
• The model methods, approach, and results will be coordinated with the City's FPA for
agreement before the Draft Drainage Report. It is anticipated there will be two in-prson
meetings with the City FPA.
Task 3: Reporting
EDGE will develop a Drainage Report which documents the methods and assumptions used for the
hydraulic analysis.The report will document the general approach, iterations in the design,and the final
results and recommendations.

Exclusions
The following assumptions were made during the development of this scope. If any of the below
services are found to be necessary during the project, EDGE will request additional services to be
considered.
• Hydrologic analysis. It is assumed the FEMA or Atlas 14 flows will be used and no hydrology is
