CM-2015-802 - 5/22/2015i TEMPORARY PARKING LICENSE AGREEMENT This Temporary Parking License Agreement is made this 2j day of % 1 W 2015, by and between the Wilbur E. McConico, Patsy M. Anderson, Evon Dee McConico, Garfield W. McConico, Jr., Byron G. Anderson, Bianca M. Jackson, and Candis Y. Jackson (hereinafter "Licensors"), and the City of Round Rock, Texas (hereinafter, "Licensee"). Whereas, Licensors are the owner of the real property (hereinafter, "Property"), as depicted in Exhibit "A", attached Hereto and incorporated herein; and Whereas, Licensee desires to utilize the Property as a temporary parking lot for the limited purpose of providing parking during and for the dedication of Veteran's Park in the City of Round Rock, Texas; and Whereas, .Licensors desire to grant Licensee certain rights and privileges upon the Property; and NOW, TIIEREFORE, it is agreed as follows: I. Licensee shall have the right to utilize the Properly as a temporary parking lot, for use by the public and employees and officials of Licensee, subject to all conditions recited herein. 2. It is understood that this Agreement creates a license only and that Licensee does not and shall not claim at any time any interest or estate of any kind in the Property by virtue of this license. 3. It is fiuther understood that thus Agreement does not grant Licensee the right to construct, install, or make improvements upon Property. 4. Licensors hereby .grant to Licensee a license to use the Property as a temporary parking lot, for the purpose of providing parking to the public and employees and officials of Licensee, during the dedication of Veteran's Park. 5. The Property may be used by Licensee as a parking lot only on the day of the dedication of Veteran's Park, which is currently scheduled to occur on May 25, 2015. • 6. Licensee accepts the Property. in its "As -Is" state of repair and condition, and Licensee •expressly agrees that. Licensors have made no representations to Licensee regarding the condition of the Property. 7. Licensee shall at. its sole cost and expense comply with all laws, statutes, ordinances, and governmental rules, regulations, or requirements regarding the use of the Property as a temporary parking lot. to f 8. Licensors shall have the eight to enter the Property at any time during Licensee's use of the Property. 9. Licensee hereby releases, relinquishes and discharges Licensors, their officers, agents and employees, from all claims, demands, and causes of action of every kind and character, for any injury to, including death, of person (whether they be third persons, contractor, or eiuployees of either of the patties hereto) and any loss of or damage to property (whether the same be that either of the parties hereto or of third parties) caused by or alleged to be caused, arising dut of, or in connection with Licensee's exercise of the license under this Agreement whether or not said claims, demands and causes of action in whole or in part are covered by insurance. • .10. This Agreement shall be construed under and accord with the laws of the State of Texas, • and all obligations of the parties created hereunder are performable in Williamson County, Texas.
