BCRUA-2025-027 - 8/27/2025 RESOLUTION NO. BCRUA-2025-027 WHEREAS, Texas Government Code, Chapter 2269 allows governmental entities to use certain methods other than competitive bidding in entering into contracts for construction of facilities, as defined therein, and WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") is considering using an alternative method other than competitive bidding in entering into a contract for the BCRUA Phase 2A Water Treatment Plant Expansion Project ("Project"), and WHEREAS, Texas Government Code, Section 2269.056(a) mandates the "governing body of a governmental entity that considers a construction contract using a method authorized by this chapter other than competitive bidding must, before advertising, determine which method provides the best value for the governmental entity," and WHEREAS, the Board of Directors of the BCRUA has determined that the Project would be best served by utilizing the"Competitive Sealed Proposal" method, Now Therefore BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY CREEK REGIONAL UTILITY AUTHORITY: In accordance with Texas Government Code §2269.056(a), the Board has determined that "Competitive Sealed Proposal" is the delivery method which provides the best value for the BCRUA Phase 2A Water Treatment Plant Expansion Project. The Board hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. 0330.4634-A:4937-9713-9553 RESOLVED this 27th day of August, 2025.
