SUPPLEMENTAL CONTRACT NO.3
TO CONTRACT FOR ENGINEERING SERVICES
FIRM: FREESE AND NICHOLS,INC. ("Engineer")

PROJECT: Addition of a 2' Electric Utility Feed to the Reuse Facility
This Supplemental Contract No. 3 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Freese and Nichols, Inc.,
hereinafter called the"Engineer."
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the"Contract,"on the 27th day of April, 2023 for the Addition of a 2nd Electric Utility Feed
to the Reuse Facility Project in the amount of$307,001.00; and
WHEREAS,the City and Engineer executed Supplemental Contract No. 1 on March 29, 2024 to
amend the scope of services and to increase the compensation by $23,662.00 to a total of
$330,663.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on June 7, 2024 to
amend the scope of services and to increase the compensation by $45,229.00 to a total of
$375,892.00; and
WHEREAS,it has become necessary to amend the Contract to modify the provisions for the scope
of services and to increase the compensation by $28,539.00 to a total of$404,431.00;
NOW THEREFORE,premises considered,the City and the Engineer agree that said Contract is
amended as follows:
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth
in the attached Addendum to Exhibit B.
I1.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$28,539.00 the maximum amount payable under the Contract for a total of$404,431.00, as shown
by the attached Addendum to Exhibit D.

ADDENDUM TO EXHIBIT "B"
ENGINEERING SERVICES
Project Understanding
The City of Round Rock(City) desires to incorporate PLC and HMI programming services for Transfer
Pump No. 3 by Plummer Associates, Inc. into the Reuse Pump Station 2nd Utility Feed and Pump Addition
Project. Based on discussions with the City,this amendment will include the following major work
elements:
1. Updating the transfer pump operation control narrative to include Transfer Pump No. 3.
2. PLC programming changes to the existing Reuse PLC to include new transfer pump control logic.
3. Submittals reviews associated with Transfer Pump No. 3.
4. On-site testing and checkout of the programming changes.
ARTICLE I
Basic Services:
Project Management Services:
1. Coordination with subconsultants.
Construction Phase
Provide the following construction phase services associated with the additional design scope noted
above.
1. Draft revised control narrative for the transfer pump operation will be finalized and submitted
to the owner(by Subconsultant).
2. PLC programming changes will be made to the existing Reuse PLC to include the new transfer
pump control logic. Updates to the HMI configuration screens will be made to remove the
clouded (future) areas and make configuration links to the new PLC program logic (by
Subconsultant).
3. PLC programming change will be enabled and tested on-site. Once the contractor has
installed and wired up the pump motor,tested rotation, and pump vendor has run the
commissioning checks, PLC wiring will be validated and the program logic will be tested. The
PLC and HMI functions will be enabled and tested in both Local/Remote and Automatic/Manual
(by Subconsultant).
4. Site visit to support Transfer Pump Programming and review operation (by Subconsultant).
5. Submittal review for control narrative, PLC, and Transfer Pump (by Subconsultant).
6. Verify proper electrical connections with contractor (by Subconsultant).
7. Verify Transfer Pump installation and pump curves with manufacturer(by Subconsultant)
8. Miscellaneous support for transfer pump programming changes by Freese and Nichols (FNI).

ARTICLE II
Revisions to Additional Services:
Any services performed by FNI that are not included in the Basic Services described above are Additional
Services. Additional Services to be performed by FNI associated with this PSSA, if authorized by City, are
described as follows:
1. More than 1 round of comment review for the Final Control Narrative will be an additional
service.
2. Additional site visits by Subconsultant beyond 2 will be an additional service.
3. Additional site visits by FNI beyond 1 to support programming or testing will be an additional
service.
4. Revisions to the construction drawings or specifications will be an additional service.
5. Additional programming services beyond those described above will be an additional service.
ARTICLE III
TIME OF COMPLETION: FNI is authorized to commence work on the Project upon execution of this
Agreement and agrees to complete the services in accordance with the following extension of the project
schedule and Exhibit C.
• Construction Phase Services No additional time is anticipated.
If FNI's services are delayed through no fault of FNI, FNI shall be entitled to adjust contract schedule
consistent with the number of days of delay. These delays may include but are not limited to delays in
City or regulatory reviews, delays on the flow of information to be provided to FNI, governmental
approvals, etc. These delays may result in an adjustment to compensation as outlined on the face of this
Agreement and in Attachment CO.
