ARTICLE I
AMENDMENTS
Section 1.01 In Article 3, § 3.5, the following new paragraph shall be added after the end of the first
paragraph:
If Contractor completes Substantial Completion of the Work by December 3, 2025, excepting the
installation of the permanent bleachers,and agrees to: i)install temporary bleachers at no cost to Owner by
October 30, 2025; and ii) install the permanent bleachers by December 31, 2025, per an agreed upon
schedule with Owner in a manner that will not impact the use and operations of the Round Rock Sports
Center facility, then Owner agrees to accept the Project as Substantially Complete on December 3, 2025.
In the event Contractor does not meet all of the conditions set forth above, Owner shall not consider and
accept the Work as substantially complete,and Contractor agrees to pay Owner the sum of$140,000.00 for
liquidated damages incurred through December 31,2025,and an additional$5,000.00 per day in liquidated
damages for each day after December 31, 2025, until the permanent bleachers are installed and Owner
considers the entirety of the Project substantially complete.
ARTICLE Ii
MISCELLANEOUS
Section 2.01 To the extent necessary to affect the terms and provisions of this First Amendment, the
Agreement is hereby amended and modified.In all other respects,the aforesaid Agreement is hereby ratified
and confirmed.
Section 2.02 This First Amendment may be executed in counterparts, each of which shall be an original
and all of which together shall constitute but one and the same instrument.
