THIS SUPPLEMENTAL AGREEMENT NO. 1 to “City of Round Rock Agreement for
Construction Consulting Services with AKH Consulting LLC” hereinafter called “Supplemental
Agreement No. 1,” is made by and between the City of Round Rock, Texas, a home-rule
municipality, with offices located at 221 East Main Street, Round Rock Texas, 78664,
hereinafter called the “City” and AKH Consulting LLC, with a mailing address of 16412 Paralee
Cove, Austin, Texas 78717, hereinafter called the “Consultant.”
WHEREAS, the City and Consultant previously executed the referenced “City of Round
Rock Agreement for Construction Consulting Services with AKH Consulting LLC,” hereinafter
called the “Agreement;” and
WHEREAS,the City and Consultant desire to modify the costs to be paid in the second
and third year of the Agreement pursuant to Section 3.0 (D) of the Agreement; and
NOW THEREFORE, in consideration of the mutual promises and obligations in the
Agreement and this Supplemental Agreement No. 1, the City and Consultant agree that said
Agreement is amended and supplemented as follows:
I.
Section 3.0 (A) and (B) of the Agreement is hereby amended to read as follows:
3.0 CONSULTING FEE
A. The consulting fee shall be $100.00 per hour for the first year of the Agreement
and $120.00 per hour for the second and third year of the Agreement.
B. The fee paid to Consultant shall not exceed $208,000.00 for the first year of the
Agreement and shall not exceed $249,600.00 for the second and third year of the
Agreement. In no event shall the total amount paid to Consultant over the term of
the Agreement exceed $707,200.00.

II.
This Supplemental Agreement No. 1 shall amend the original Agreement only as set forth
herein with no other changes in terms or conditions of the original Agreement.
IN WITNESS WHEREOF,the City and Consultant have executed this Supplemental
Agreement to be effective as of the last date of due execution by both parties.
