DECLARATION OF WATER LINE EASEMENT

COUNTY OF WILLIAMSON §
WHEREAS,the City of Round Rock(the"City") is the owner of property located at 2400
Chisholm Trail Road, Round Rock, Texas 78681, conveyed to the City in Document No.
2010087422 of the Official Public Records of Williamson County, Texas (the "City Property");
and
WHEREAS, the City desires to use a portion of the City Property for location of a water
line easement("Water Line Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City makes the
following Declaration of a Water Line Easement:
That the CITY OF ROUND ROCK, a Texas home-rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of a Water Line Easement for
the purpose of establishing the following exclusive easement in and under the following described
property in Williamson County, Texas, to-wit:
Being a 0.538 of an acre easement situated in Lot 1, REPLAT OF CALCASIEU
LUMBER ADDITION, a plat of which is recorded in Cabinet P, Slide 16, of the
Plat Records of Williamson County,Texas,being conveyed to City of Round Rock,
Texas per Instrument Number 2010087422, of the Official Public Records of
Williamson County, Texas; said 0.538 acres of land being further described by
metes and bounds and sketch in Exhibit"A," incorporated herein for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used to
construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove a water distribution system and water lines, together with all necessary lines, pipes,
conduits, valves, vaults, manholes, ventilators, and other equipment, improvements, accessories
and appurtenances or operations and any other necessary accessories thereto.
Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by

Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual.
The benefits and obligations of the easement created herein shall constitute benefits and
