§ KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
WHEREAS, pursuant to that certain Acknowledgment and Pipeline Easement, dated
October 11,2001, and recorded in Instrument No. 2001089179 of the Real Property Records
of Williamson County, Texas (the "Easement"), City of Round Rock ,("Grantor")
granted to TXU Gas Company, its successors and assigns, (the"Grantee") a right-of-way
and easement over that certain tract located in Williamson County, Texas more particularly
described in the Easement (the "Easement Property");and
WHEREAS, Grantor, as successor-in-interest, with respect to the Easement on the
Easement Property,and Atmos Energy Corporation, a Texas and Virginia corporation, have agreed
to amend the Easement,as further set forth herein, in order to amend the description of the Easement
Property,as further set forth below.
NOW,THEREFORE, for and in consideration of the sum of Ten Dollars($10.00)and other
good and valuable consideration,the parties agree as follows:
I. Amendment to Easement Property.The Easement is hereby amended to add to the Easement
Property more particularly described on Exhibit "A" attached (the "New Easement
Property"). The New Easement Property shall be subject to the terms and conditions of the
Easement in the same manner as if it had been part of the Easement Property from the original
date of the Easement.
2. No Other Amendment. Except as expressly amended by this Amendment of Easement, all
terms and conditions of the Easement shall remain in full force and effect, including,without
limitation,any rights of access to and from the Easement Property.
