DECLARATION OF WASTEWATER EASEMENT

§ KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
WHEREAS,the City of Round Rock(the"City")is the owner of property located at 8030
CR 110, Round Rock, Texas 78665, conveyed to the City in Document No. 2018096958 of the
Official Public Records of Williamson County, Texas (the "City Property"); and
WHEREAS, the City desires to use a portion of the City Property for location of a
wastewater easement("Wastewater Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City makes the
following Declaration of a Wastewater Easement:
That the CITY OF ROUND ROCK, a Texas home-rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of a Wastewater Easement for
the purpose of establishing the following exclusive easement in and under the following described
property in Williamson County,Texas, to-wit:
Being a 0.3841 acre (or 16,730 square feet) tract in the Robert McNutt Survey,
Abstract No. 422, in the City of Round Rock, Williamson County,Texas, being out
of a called 40.052 acre tract of land to the City of Round Rock, Texas, a Texas
home rule municipality, conveyed in a Special Warranty Deed dated October 31,
2018 as recorded in Document No. 2018096958, Official Public Records of
Williamson County, Texas; said 0.3841 acre tract of land being further described
by metes and bounds and sketch in Exhibit "A," incorporated herein for all
purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used to
construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove a wastewater system and lines, together with all necessary lines, pipes, conduits, valves,
vaults, manholes, ventilators, and other equipment, improvements, accessories and appurtenances
or operations and any other necessary accessories thereto.
Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant

will not be responsible or liable for any damage to utilities placed within the easement caused by
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.
