After being informed of these procedures it is our desire to waive our right of appraisal and choose to sell this right of way for the consideration included in this letter so that the proposed Kenney Fort Boulevard (Seg 5/6) roadway construction project may proceed in a timely fashion. Therefore, we would like to offer to sell by Deed to the City of Round Rock, Texas ("City") approximately 1.211 acre (52,735 square foot) (Parcel 13) of needed right of way, in the form as shown in Exhibit "A" attached hereto and incorporated herein, and to be executed and delivered to the City following full execution of this Agreement. The parties additionally agree as follows: As consideration for providing the Deed identified herein, as an obligation which shall survive the completion of this Agreement, City agrees that as part of the construction of the proposed Kenney Fort Blvd. roadway improvement project it shall cause sidewalk and/or pedestrian path and appurtenances to be constructed at its sole cost and expense along the project and connecting Paloma Lake MUD No. 1's existing sidewalk system, in substantial compliance with the locations, plans and specifications as shown in Exhibit "B" attached hereto and incorporated herein. The construction and materials used must be of as good or better quality than the sidewalk currently located on the subject property parent tract.
