R-2026-059 - 3/12/2026 RESOLUTION NO.R-2026-059 WHEREAS, the City of Round Rock ("City") and Brooks Bennett ("Employee") entered into the Employment Agreement Between the City of Round Rock, Texas and Brooks Bennett for the Position of City Manager(the`Employment Agreement")on November 7, 2024; and WHEREAS,the City and Employee amended the Employment Agreement on August 28,2025 ("First Amendment"); and WHEREAS, City and Employee desire to further amend the Employment Agreement ("Second Amendment"),Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City, Second Amendment to Employment Agreement Between the City of Round Rock, Texas and Brooks Bennett, a copy being attached hereto as Exhibit"A"and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code,as amended. CRAI MOAN,Mayor City o Ro Rock,Texas ATTEST: (L � ANN FRAMd1N,City Clerk 0112.20262 EXHIBIT A SECOND AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN THE CITY OF ROUND ROCK,TEXAS AND BROOKS BENNETT THIS SECOND AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN THE CITY OF ROUND ROCK, TEXAS AND BROOKS BENNETT (this "First Amendment") is effective as of the day of , 2026, by and between CITY OF ROUND ROCK, TEXAS, a home-rule municipality ("City"), and BROOKS BENNETT, City Manager of Round Rock,Texas ("Employee"). RECITALS WHEREAS, the City and Employee entered into the Employment Agreement Between the City of Round Rock, Texas and Brooks Bennett for the Position of City Manager (the "Employment Agreement")on November 7, 2024; and WHEREAS, the City and Employee previously amended said Agreement by deleting Section 14 ("First Amendment"); and WHEREAS, the City and Employee desire to amend the Employment Agreement upon the terms and conditions more particularly set forth herein; NOW, THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,the parties mutually agree as follows: I. Sections 5(A), 5(B), and 5(E)are hereby amended to read as follows: A. The current base salary of$332,808.32 per year. B. A car allowance of 10 per month. E. The City will pay for the Employee's portion of the contribution (currently 7% of base salary) into the Texas Municipal Retirement System, provided however, that if the City adopts a higher required member contribution rate for its employee, the Cily shall pay such higher rate on behalf of Employee. II. To the extent necessary to affect the terms and provisions of this Second Amendment,the Agreement is hereby amended and modified. In all other respects,the aforesaid Agreement is hereby ratified and confirmed. IN WITNESS WHEREOF, The City Council of Round Rock, Texas, has authorized the City's Mayor to execute this Second Amendment to Employment Agreement, and the same has been duly attested to by its City Clerk, and signed by Employee, in duplicate, the day and year first written above.
