Contract - City Manager - 3/12/2026 SECOND AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN THE CITY OF ROUND ROCK,TEXAS AND BROOKS BENNETT THIS SECOND AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN THE CITY OF ROUND ROCK, TEXAS AND BROOKS BENNETT (this "First Amendment") is effective as of the 12+1% day of AAjCJA , 2026, by and between CITY OF ROUND ROCK, TEXAS, a home-rule municipality ("City"), and BROOKS BENNETT, City Manager of Round Rock,Texas ("Employee"). RECITALS WHEREAS, the City and Employee entered into the Employment Agreement Between the City of Round Rock, Texas and Brooks Bennett for the Position of City Manager (the "Employment Agreement")on November 7, 2024; and WHEREAS, the City and Employee previously amended said Agreement by deleting Section 14("First Amendment"); and WHEREAS, the City and Employee desire to amend the Employment Agreement upon the terms and conditions more particularly set forth herein; NOW, THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,the parties mutually agree as follows: I. Sections 5(A), 5(B), and 5(E)are hereby amended to read as follows: A. The current base salary of$332,808.32 per year. B. A car allowance of$1,000.00 per month. E. The City will pay for the Employee's portion of the contribution (currently 7% of base salary) into the Texas Municipal Retirement System; provided however, that if the City adopts a higher required member contribution rate for its employee, the Cily shall pay such higher rate on behalf of Employee. H. To the extent necessary to affect the terms and provisions of this Second Amendment,the Agreement is hereby amended and modified. In all other respects,the aforesaid Agreement is hereby ratified and confirmed. IN WITNESS WHEREOF,The City Council of Round Rock, Texas, has authorized the City's Mayor to execute this Second Amendment to Employment Agreement, and the same has been duly attested to by its City Clerk, and signed by Employee, in duplicate, the day and year first written above.
