CM-2026-073 Exhibit "A," said Addendum incorporated herein by reference for all purposes, titled "Scope of Services." which shall be referred to as the Scope of Services of this Agreement and incorporated herein by reference for all purposes. B. Consultant shall satisfactorily provide all Consulting Services described herein and as set forth in Exhibit "A" and the attached Addendum to Exhibit "A," in compliance with an agreed upon work schedule. Consultant's undertaking shall be limited to performing Consulting Services for City and/or advising City concerning those matters on which Consultant shall perform the Consulting Services in accordance with this Agreement in a professional and workmanlike manner pursuant to the Work Schedule agreed upon by both parties. 11. Section 3.0 of the Agreement is hereby arnended to read as follows: 3.0 LIMITATION TO SCOPE OF SERVICES Consultant's undertaking shall be limited to performing the Consulting Services for City and/or advising City concerning those matters on which Consultant has been specifically engaged. Consultant and City agree that the Scope of Services to be performed is enumerated in Exhibit "A," and the Addendum to Exhibit "A," and may only be modified by a written Supplemental Agreement executed by both parties as described in Section 9.0. III. Section 4.0 of the Agreement is hereby amended to read as follows: 4.0 CONTRACT AMOUNT A. In consideration for providing the Consulting Services, Consultant shall be paid on the basis of actual hours worked provided by Consultant in accordance with the Fee Schedule in Exhibit "A and Addendum to Exhibit "A," attached hereto, and incorporated herein by reference for all purposes. B. Consultant's total compensation for Consulting Services hereunder shall not exceed 594,961.34. This amount represents the absolute limit of City's liability to Consultant hereunder unless same shall be changed by Supplemental Agreement, and City shall pay, strictly within the not-to-exceed sum recited herein, Consultant's fees for work done on behalf of City. V. This Supplemental Agreement No. I shall amend the original Agreement only as set forth herein with no other changes in terms or conditions of the original Agreement. Sandre, City Attorney 3 Addendum to Exhibit "A" SUPPLEMENTAL AGREEMENT NO. 1 To Contract No. 2025-182 City of Round Rock- Business Center Assessment & Programming Consultant: MOD: Architecture, Inc. City: City of Round Rock, Texas Date: March 2, 2026 This Supplemental Agreement No.1 ("Agreement") is executed pursuant to Contract No. 2025-182, dated July 25,202S ("Original Agreement"), between the City of Round Rock ("City") and MOD:Architecture, Inc. ("Consultant"). During the performance of the Assessment and Programming Services included in Exhibit A of the Original Agreement, the City and Consultant jointly identified the need for additional investigative and diagnostic services to better inform the structural, geotechnical, and building systems evaluation of the Business Center facility.These services were not included in Exhibit A and require the engagement of additional subconsultants as well as expanded coordination and reporting by the Consultant. This Supplemental Agreement defines the scope of the Additional Services and establishes the associated Additional Compensation. I. ADDITIONAL SCOPE OF SERVICES The following services are added to the Consultant's scope under the Original Agreement.These services supplement and expand the Exhibit A Assessment tasks and are required to support the City's objectives for the Business Center Project. A. Structural Elevation Surveys - RDHammond Consulting & Engineering, LLC ("RDH C&E LLC") (Existing Subconsultant) RDH C&E LLC shall provide: 1. A full-building structural elevation survey, including ground floor slab, second floor slab, roof, and parapet coping caps, expanding beyond the limited 9/9/25 survey. 2. A second full-building elevation survey, approximately three months following the first,to assess potential movement. 3. Existing steel braced frame analysis, including full structural finite 3D element modeling and reporting for new elevations. Addendum to Exhibit "A" 4. Documentation and digital deliverables enabling integration into the Consultant's Assessment Report. B. Comprehensive Storm & Sanitary Waste System Diagnostic Services— AiRCO Mechanical (New Subconsultant) AiRC© shall provide: Phase 1: Storm &Sanitary Waste Main Investigation 1. Supply tools and material to camera and hydrostatically test the storm and sanitary waste mains. 2. Video documentation of underground storm and sanitary mains and mark any observed line breaks on the floor. 3. Observations on hydrostatic water level changes to detect potential leakage. 4. A summary of test findings, including the aforementioned video documentation, for integration into the Consultant's Assessment Report. 5. Camera work is to be performed during normal business hours on a Friday; hydrostatic testing is to be performed after normal business hours on a Saturday. Phase 2A: Hydro jet Sanitary Waste prior to Inspection 1. Supply tools and material to hydro-jet sewer lines prior to continuing sewer line camera inspection. 2. Work includes one (1) two-man crew on a Saturday for up to 8 hours of hydro- jetting. 3. A brief summary of jetting completion and any significant obstructions encountered that may impact the Phase 2B camera investigation. Phase 213: Additional Sanitary Waste Branch Inspection 1. Supply tools and material to continue the underground sewer waste investigation, specifically including toilet and sink branch lines. 2. Work includes two (2),two-man crews on a Saturday for up to eight (8) hours of inspection to be performed after normal business hours. C. MEP Consultant Additional Services-AYS Engineering, LLC (Existing Subconsultant) AYS Engineering shall provide: 1. Review and analysis of the reports generated by the plumbing subcontractor (AiRCO) regarding the camera and hydrostatic testing of the building drainage systems. 2. Guidance throughout the investigation as well as evaluation and reporting on the resu Its. Addendum to Exhibit "A" D. Consultant's Additional Architectural Services — MOD Architecture, Inc. The works listed below exceed the level of effort described in Exhibit A of the Original Agreement and are therefore Additional Services. Consultant shall: 1. Coordinate schedules, building access, and scope alignment for each subconsultant listed above. 2. Participate in on-site walkthroughs with the City and subconsultants as needed to clarify investigation requirements and site constraints. 3. Integrate all consultant findings into the Business Center Assessment Report, including narrative updates, revised diagrams, supporting data tables, and impact analysis. 4. Update the Assessment's recommendations and prioritization based on new diagnostic information. S. Provide expanded coordination and communication with City staff regarding findings, scheduling, and impacts to the overall Assessment. 6. Coordinate Geotechnical Peer Review of prior documentation and integrate their findings into the Assessment Report. II. EXCLUSIONS The following services are not included in this Supplemental Agreement: • Design of repairs, remediation, or corrective work associated with identified deficiencies. • Detailed structural or geotechnical analysis beyond the scopes of RDHammond. • Any destructive testing outside the scopes listed above. • Construction phase services, monitoring, or inspection of corrective work. • Additional investigative scopes requested by the City after execution of this Agreement unless separately authorized. III. ADDITIONAL COMPENSATION The City shall compensate the Consultant for these Additional Services as follows. Consultant's responsibility for subconsultant services is limited to coordination and integration of deliverables; Consultant does not assume responsibility for technical accuracy or performance of subconsultants. 3. Work may proceed only upon execution of this Supplemental Agreement by the City. 4. The compensation established herein shall amend the compensation terms of the original Contract.
