THIS SUPPLEMENTAL AGREEMENT NO. 3 to “City of Round Rock Agreement for
Architectural Services for City of Round Rock Fire Station No. 10 with McKinney Architects,
Inc.,” hereinafter called “Supplemental Agreement No. 3,” is made by and between the City of
Round Rock, Texas, a home-rule municipality (hereinafter referred to as the “City”), located at
221 East Main Street, Round Rock, Texas 78664, and McKinney Architects, Inc., whose
offices are located at 1301 East Seventh Street, Austin, Texas 78702 (hereinafter referred to as
“Architect”).
WHEREAS, the City and Architect executed the referenced “City of Round Rock
Agreement for Architectural Services for City of Round Rock Fire Station No. 10 with
McKinney Architects, Inc.,” hereinafter called the “Agreement” on June 27, 2024 by Resolution
No. R-2024-158; and
WHEREAS, the City and Architect also executed Supplemental Agreement No. 1 on
June 27, 2024 supplementing said Agreement; and
WHEREAS, the City and Architect subsequently executed Supplemental Agreement No.
2 amending the Agreement to add additional services pursuant to Section 1.1.2.4(C) of the
Agreement and to increase the compensation by $14,300.00 to $298,500.00; and
WHEREAS, the City and Architect desire to further amend the agreement to additional
construction administration services and increase the compensation by $8,350.00 to $306,850.00;
and
NOW THEREFORE, premises considered, and in consideration of the mutual promises
and obligations in the Agreement and this Supplemental Agreement No. 3, the City and Architect
agree as follows:
I.
Section 1.1.2.3, shall be amended as set forth in the attached Addendum to Exhibit A,
incorporated by reference for all purposes.

II.
Section 1.1.2.4 shall be amended by increasing the not-to-exceed amount payable pursuant to the
Agreement by $8,350.00 for a total of $306,850.00, as shown by the attached Addendum to
Exhibit “A.”
III.
This Third Supplemental Agreement shall amend the original Agreement only as set forth
herein with no other changes in terms of conditions of the original Agreement.
IN WITNESS WHEREOF,the City and Consultant have executed this Supplemental
Agreement No. 3 to be effective as of the last date of due execution by both parties.

Dear Mr.Will,
As requested, McKinney York Architects (MYA) is pleased to submit the following proposal
for your consideration to provide additional construction administration services requested
by the City during the on-site construction meeting held on October 2,2025.These additional
services are proposed in response to the City's determination,following the commencement
of construction,that the level of MYA's involvement provided on previous fire station projects
should be expanded for this project to ensure consistent oversight and support.
In accordance with our Agreement dated June 27,2024,and pursuant to§1.1.2.4.C,we are
requesting approval for Additional Services necessitated by"substantive changes in Project
Scope, [or] additional work necessitated by unknown or reasonably unforeseen
circumstances." Site visits beyond one per month and attendance at all Owner—Architect—
Contractor (OAC) Meetings were not included as part of the original project scope as
described in§1.1.2.3 of our Agreement.
Services
1. Architectural Services-Construction Administration
Compensation for site visits during the Construction Phase is based on one(1)site visit
per month, exclusive of regularly scheduled OAC Meetings. The following outlines the
additional services requested by the City:
A. November-December,2025(2 months)
(1) Attendance at one(1) OAC Meeting each month,to be held in conjunction with
the previously contracted site visit on the second (2nd) Thursday of each
month.
B. January-August 2026(8 months)
During this period, MYA will provide the following additional services:
(1) Attendance at one (1) QAC Meeting each month, held in conjunction with the
previously contracted site visit on the second (2nd)Thursday of each month.

(2) Attendance at one (1) additional OAC Meeting and site visit each month,to be
held on the fourth (4th)Thursday of each month.
Compensation
If accepted below by the owner, McKinney York Architects agrees to provide the Services
described above for compensation as follows:
Stipulated Not-to-Exceed (NTE)Sum of$8,350
