CM-2026-136 - 5/8/2026 SUPPLEMENTAL AGREEMENT NO. 1 TO "AGREEMENT BETWEEN THE CITY OF ROUND ROCK AND PARADIGM CONTRACTING FOR THE PURCHASE OF PARKS AND RECREATION EQUIPMENT" CITY OF ROUND ROCK § § STATE OF TEXAS § KNOW ALL BY THESE PRESENTS: § COUNTY OF TRAVIS § COUNTY OF WILLIAMSON § THIS SUPPLEMENTAL AGREEMENT NO. 1 to "Agreement Between the City of Round Rock and Paradigm Contracting for the Purchase of Parks and Recreation Equipment" called "Supplemental Agreement No. 1," is made by and between the CITY OF ROUND ROCK, TEXAS, a home-rule municipality, with offices located at 221 East Main Street, Round Rock, Texas 78664-5299 (referred to herein as the "City"), and PARADIGM CONTRACTING, whose offices are located at 10719 Twilight Vista, Austin, Texas 78736 (referred to herein as"Vendor"). WHEREAS, the City and Vendor previously executed the referenced "Agreement Between the City of Round Rock and Paradigm Contracting for the Purchase of Parks and Recreation Equipment,"hereinafter called the"Agreement;" and WHEREAS, the Agreement states that the total amount of costs to be paid to Vendor shall not exceed$450,921.00 for the term of the Agreement; and WHEREAS, the parties desire to increase the Contract Amount by an additional $12,951.63 as set forth herein; NOW THEREFORE, in consideration of the mutual promises and obligations in the Agreement and this Supplemental Agreement No. 1, the City and Vendor agree that said Agreement is amended and supplemented as follows: I. 1.0 The total amount of costs to be paid pursuant to this Agreement shall be increased by $12,951.63, as set forth in the attached Addendum to Exhibit "A," incorporated herein by reference for all purposes, for a new not-to-exceed total of $463,872.63 for the term of the Agreement. CM-2026-136 II. 2.0 This Supplemental Agreement No. 1 shall amend the original Agreement only as set forth herein with no other changes in terms or conditions of the original Agreement. Austin,TX 78736 DP 512-300-3636 '512-692-2947 www,paradigmcontract.corn Addendum to Exhibit "A" PARADIGM CONTRACTING Respectfully Submitted by: 3-Lefer► RergoEd Approved by: Date: GENERAL TERMS AND CONDITIONS AND WARRANTY Installation charges are for a"standard" installation unless specifically noted to be otherwise.Installation charges are due upon completion.Standard installations are based upon a soil work site,that is freely accessible by truck,(no fencing,tree/landscaping or utility obstacles,etc.),and level,(+/-1-2%maximum slope).An accessible water source must be available to the installer.Any site work that is not expressly described is excluded.Standard installation does not include any extra or additional machinery,drillers,etc.,for rock excavation.If rock conditions are encountered,additional charges will apply. Standard installations generally require from 2-10 business days to complete,depending upon the amount and type of equipment,site conditions,weather,and the installer's schedule.Work may or may not be performed in consecutive days.Engineered wood fiber and shredded rubber surfacing are spread,not compacted,rolled,or watered.The Customer is responsible for locating and clearly marking all underground utilities in the installation area before any installation work can begin.The installer is not responsible for damages,repairs,or discontinuance of business due to damaged utilities. If applicable,sprinkler system locates,re-working and repairs are excluded from installation charges. Installation of all products,(equipment,borders,fall surfacing and amenities)are as quoted and approved by acceptance of quotes and drawings.As a precautionary measure,work in progress areas will be taped off at the end of the workday.Pier spoils from installation shall be spread at site.The installer is not responsible for any damages or re-works resulting from afterhour's events or activities during the work in progress period. Temporary fencing is only provided by specific request,and additional charges will apply.Collectively and/or individually,the installation company shall not be held liable for any damages resulting from misuse,vandalism, or neglect.Any deviations from approved and accepted placement of all items,along with additional work,over and above quoted items,will be chargeable to the customer.Once work is completed the customer will be notified if present at the job site,and all responsibility of any new work will be transferred to the customer.The customer is responsible for maintaining the integrity of completed installation work until all components have seated and/or cured(concrete footings,etc.).
