WHEREAS, the City of Round Rock("City") has previously entered into an engagement letter
with Allensworth Law dated October 31, 2025 and a supplemental engagement letter dated April 17,
2026 regarding legal services in the lawsuit styled Thalle Construction Company, Inc. v. city of Round
Rock, Cause No. 26-1071-C480 in the 480`h Judicial District Court of Wiliamson County, Texas; and
WHEREAS, Allensworth Law has submitted an additional supplemental engagement letter to
provide said services; and
WHEREAS, the City Council wishes to enter into said supplemental engagement letter with
Allensworth Law, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City a
Supplemental Engagement Letter with Allensworth Law, a copy of said engagement letter being
attached hereto as Exhibit"A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

Brushy Creek Regional Wastewater Treatment Plant Expansion Project
Dear Brooks:
This is a Supplemental Engagement Letter to the agreement for payment of fees and
expenses described in our engagement letter dated October 31, 2025. The remaining terms and
conditions contained in the October 31, 2025 engagement letter not specifically described herein
remain in effect and are incorporated as if fully set forth herein. The engagement includes
defending the City of Round Rock in the lawsuit styled Thalle Construction Company, Inc. v. city
of Round Rock, Cause No. 26-1071-C480 in the 480t1i Judicial District Court of Williamson
County, Texas.
This engagement will be limited to a not-to-exceed budgeted amount of $100,000.00.
Should our scope expand, or should the existing, limited scope approach this amended not-to-
exceed budget, we will submit an additional supplemental or amended engagement letter for
review and approval by the City Manager for the City of Round Rock, Texas. As we have added
new employees to the firm since our last engagement letter, I've attached an updated rate sheet
with all current employees for your records.
If you have any questions about the terms of this supplemental engagement,please let me
know immediately. We request that you sign and date in the space provided below and return a
copy of this letter to reflect that you are aware of and agree to the terms and conditions of this
representation.
