WHEREAS, the City of Round Rock ("City") entered into a contract on December 21, 2023
with SpawGlass Contractors, Inc., entitled "Standard Form of Agreement Between Owner and
Construction Manager as Constructor where the basis of payment is the Cost of Work Plus a Fee with a
Guaranteed Maximum Price" ("Agreement"), and such contract is for the Old Settlers Park Buildout
Project(Recreation Center); and
WHEREAS, as part of the Agreement, savings during the execution of construction are returned
to the City; and
WHEREAS, the City Council wishes to approve the amount of$990,710.00 to be unallocated
from construction via a change order in accordance with the attached Change Order No. 1, Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City,Change Order
No. 1 to the Agreement with SpawGlass Contractors, Inc. for the Old Settlers Park Buildout Project
(Recreation Center), a copy of said change order being attached hereto as Exhibit "A" and incorporated
herein for all purposes.
The City Council hereby finds and declares that written notice of the date,hour,place and subject
of the meeting at which this Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and the subject matter hereof were
discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551,
Texas Government Code, as amended.
