THIS SUPPLEMENTAL AGREEMENT NO. 1 to "Agreement between the City of
Round Rock and Terracon Consultants, Inc. for Construction Materials Testing Services for the
Fire Station No. 10 Project," hereinafter called "Supplemental Agreement No. 1," is made by
and between the CITY OF ROUND ROCK, Texas, a home-rule municipality, with offices
located at 221 East Main Street, Round Rock Texas, 78664, hereinafter called the "City" and
TERRACON CONSULTANTS, INC., with offices located at 800 Paloma Drive, Suite 150,
Round Rock, Texas 78665,hereinafter called the"Consultant."
WHEREAS, the City and Consultant previously executed the referenced "Agreement
between the City of Round Rock and Terracon Consultants, Inc. for Construction Materials
Testing Services for the Fire Station No. 10 Project" for the provision of construction material
testing services, hereinafter called the"Agreement;"and
WHEREAS, the City and Consultant agree to add costs for additional services in the
amount of$38,054.00; and
NOW THEREFORE, in consideration of the mutual promises and obligations in the
Agreement and this Supplemental Agreement No. 1, the City and Consultant agree that said
Agreement is amended and supplemented as follows:
I.
1.0. CONTRACT AMOUNT
This Supplemental Agreement No. 1 shall increase the total compensation set forth in
Section 5.0 of the Agreement by $38,054.00, as set forth in the attached Exhibit "A,"
incorporated herein by reference for all purposes, for a not-to-exceed total of$96,204.00 for the
term of the Agreement.

2.0 AMENDMENTS TO AGREEMENT
This Supplemental Agreement No. 1 shall amend the original Agreement only as set forth
herein with no other changes in terms or conditions of the original Agreement.

IN WITNESS WHEREOF, the City and Consultant have executed this Supplemental
Agreement to be effective as of the last date of due execution by both parties.

Dear Mr. Schiller,
We are submitting this request to increase the budget previously established for the construction
materials observation and testing services for the CORR Fire Station No. 10 project. The previously
established budget for these services is $58,150. A change order is needed to account for additional
trips for additional testing and inspections for structural masonry. Additional services provided include
more time per masonry inspection than originally budgeted, more grout prisms testing than budgeted
because of samples needed for each bond beam rather than each day of production, and additional
mortar cube testing caused by the change in masonry subcontractors. With that said, we are
requesting that the budget allocated for this project be increased by $38,054 to a total of$96,204 to
account for the services provided, according to the attached Exhibit C, Cost Estimate and Fee
Schedule.
We understand that authorization for these additional services will be done through issuance of a
supplemental agreement from the City of Round Rock.

Reimbursable Expenses
Direct non-salary project expenses for"outside"services are billed at cost plus 15 percent for handling.
These include but are not limited to the following: travel and lodging, external consultants,
environmental analytical tests, drilling, special supplies, permits, equipment, sampling, field testing, on-
site facilities, clearing/grading contractors, water trucks, bulldozers, security forces, surveyors, traffic
control or other support services.
Remarks
A four-hour minimum charge is applicable to all trips made for the performance of structural steel,
firestopping, and wood testing/inspection services. A minimum charge of two hours will be assessed
for trips to the project site for sample or cylinder pick up only and a three-hour minimum charge is
applicable to all trips made for the performance of other testing, inspection, cancellations or consulting
services.
All labor, equipment, and transportation charges are billed on a portal-to-portal basis from our office up
to the nearest half hour.
Overtime rates of 1.5 times the quoted hourly rate will be applicable for all time worked in excess of
eight(8) hours per day, all time worked outside of daylight hours of 6:00 AM to 6:00 PM Monday through
Friday, and all time worked on Saturdays.
Overtime rates of 2 times the quoted hourly rate will be applicable for all time worked on Holidays and
Sundays.
Services that are not cancelled by the prior business day, during business hours (8am to 5pm), will be
subject to a cancellation charge of$200.
Court appearances, depositions, etc. will be charged at 1.5 times the quoted hourly rate.
Unit fees for tests not listed will be quoted on request.
Rush testing and inspection services are subject to a surcharge (to be negotiated).
Engineering consultation and evaluation in connection with any laboratory testing or field inspection
service will be charged at the appropriate rate.

Material samples should be submitted in a form that complies with applicable requirements.
Terracon will submit invoices for services on a monthly basis. Payment for services shall be made within
30 days of receipt of the invoice in accordance with the Terracon "Agreement for Consulting Services"
or"Authorization To Proceed". Additional administrative charges may be applicable if the client requires
other invoicing procedures or payment terms.
