THIS AGREEMENT REGARDING RELOCATION OF WATER SYSTEM
IMPROVEMENTS ("Agreement") is entered into by and between Manville Water Supply Corporation
("Manville") and the City of Round Rock, Texas, a Texas home rule municipality ("Round Rock"). In this
Agreement, Manville and Round Rock are sometimes individually referred to as "a Party" and collectively
referred to as"the Parties".
WHEREAS, Round Rock is and has been in the process of constructing improvements to
Gattis School Road, Segment 6 (the "Road Project"); and
WHEREAS, the proposed Road Project includes additional drainage that will flow in a
detention pond located on the southeast comer of Red Bud Lane and Gattis School Road; and
WHEREAS,to avoid any conflict between the culverts to be installed as part of the Road
Project and Manville's existing waterlines, Manville agrees to relocate its 8"PVC waterline as set
forth in the Plans attached as Exhibit "A," incorporated herein by reference for all purposes,
pursuant to the terms set forth herein ("Relocation Project"); and
NOW, THEREFORE, in consideration of the foregoing premises and the mutual
promises and agreements of the Parties contained in this Agreement, the Parties agree as follows:
I.
GENERAL STATEMENTS
1.01 Costs. Round Rock will, at its own expense, pay all costs related to the Relocation
Project. The costs are estimated to be $46,506.36 as set forth in Exhibit `B," attached hereto and
incorporated herein by reference for all purposes.
1.02 Manville Obligations. Manville shall be responsible for the timely completion of
the Relocation Project.
II.
CONSTRUCTION OF RELOCATION PROJECT
2.01 General. The Parties mutually acknowledge and agree that Manville shall
complete the Relocation Project. Round Rock agrees that it is responsible for one hundred percent
(100%) of the costs of the Relocation Project.
2.02 Payment and Maintenance. Round Rock's payment for the Construction Costs
will be due and owing thirty (30) days after the Manville has completed the Relocation Project.

This document constitutes only an estimate of costs for Manville to extend water service to the Applicant's property, and it may include the cost of the
water meter, if applicable. Any cost overruns will be billed to you following completion of the work and must be paid prior to the meter installation.
Additional charges may also apply if repairs to landscaping,driveways or roads are necessary. Manville makes no representations,written or verbal,other
than those in this estimate. This is not a commitment to provide water service. The commitment to provide water service will be made only after all
documents (including application for water service, approved cost estimate, easements, etc.) are received at the Manville office and all fees are paid.
Water meters will not be set until payment in full is received for the extension of service and also the cost of the meter. After thirty(30)days from the date
stated above,this estimate expressly expires and may be extended only by the development of another Cost Estimate to extend water service by Manville or
by an express written extension of this estimate to a certain date not to excel thirty(30)days.
I have read and agree to these terms for the extension of water service to my above-referenced property.
