CM-2026-222 - 8/28/2026Supplemental Contract Rev.06/16 0199.202238 84275 1 STATE OF TEXAS § § COUNTY OF WILLIAMSON § SUPPLEMENTAL CONTRACT NO. 4 TO CONTRACT FOR ENGINEERING SERVICES FIRM: KIMLEY-HORN AND ASSOCIATES, INC. ADDRESS: 5301 Southwest Parkway, Building 2, Suite 100, Austin, TX 78735 PROJECT: Kenney Fort 24-inch Reuse Line Extension This Supplemental Contract No. 4 to Contract for Engineering Services is made by and between -Horn and Associates, WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter 2022 for the Kenney Fort 24-inch Reuse Line Extension Project in the amount of $616,200.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on August 24, 2023 to amend the scope of services and to increase the compensation by $110,000.00 to a total of $726,200.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on October 11, 2024 to amend the scope of services and to increase the compensation by $35,600.00 to a total of $761,800.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on November 8, 2024 to amend the scope of services and to increase the compensation by $25,100.00 to a total of $786,900.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $99,900.00 to a total of $886,800.00; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Sandre, City Attorney Printed Name: Title: Date Signed: B-1 SUPPLEMENTAL #4 CONSULTANT ADDITIONAL SERVICES ADDENDUM TO EXHIBIT B ENGINEERING SERVICES Based on coordination with City staff, an extension to the proposed alignment has been added to serve a nearby development. With the project currently in construction, this supplemental scope of work will include the accelerated design of an additional 1,220 linear feet of 8-inch reuse water line. Kenney Fort Blvd 24-inch Reuse Water Line (Phase I) Approximately 11,900 linear feet o Proposed 24-inch reuse water line along Kenney Fort Blvd from Forest Creek southeast of Kalahari Blvd. The reuse line will traverse the tree line on the South side of the Kalahari property and then travel northeast to connect to an existing reuse line at the Brushy Creek East Regional WWTP. o Proposed 8-inch reuse water line connecting from the 24-inch line on the south side of the Kalahari property and crossing under Kenney Fort Bridge, paralleling the trail on the north side of Brushy Creek, to the proposed Stockwell property development. Task 1 Design Management, Project Meetings, and Data Collection Design Management The Engineer will manage the design and work associated with the scope described in subsequent sections and provide the following communication and reporting: Progress Report (one per month) Communication and reporting for an additional two (2) months for a total of eighteen (18) month duration for design Project Meetings The Engineer will prepare for and attend meetings with the Owner, to the extent requested by the Owner and budgeted for in this agreement. The following project meetings are anticipated: An additional one (1) for a total of nine (9) progress meetings to discuss specific design or coordination items associated with the project One (1) coordination meeting with the Engineer associated with the Stockwell property connecting to the 8-inch reuse water line. Task Deliverables: Meeting minutes for each meeting attended B-2 Data Collection The Owner will be responsible for making the following data available in the vicinity of the projects for the Engineer: Owner Provided Data Collection o Owner GIS/KMZ Data Storm Wastewater Water Reuse High resolution aerials photography Lidar Contours o Owner Record Drawings Water Wastewater Reuse Traffic Signal and Communication Storm Roadway Parks/Trail Maps and Irrigation Records, if available Franchise Coordination by Engineer o The Engineer will prepare a data request email notifying each organization, listed below of the proposed project. Engineer will attempt to collect information from the utilities listed: Gas Company (Atmos Energy) Communication Providers Task 3 Preliminary Design (60%) Design and Boundary Survey (Sub-Consultant - Inland Geodetics, LLC.) o Design Survey for additional 1,220 linear feet of reuse water line route. On the ground survey: Topo survey along the recommended alignment for a width up Existing manholes, valves, inlets, road poles, driveway connections, and other observable above ground existing structures will be located within the project area. Establish control points along the route. Geotechnical Analysis (Subconsultant: Raba Kistner Consultants, Inc.) The Sub- Consultant will perform a geotechnical analysis of the proposed reuse water B-3 alignment utilizing a geotechnical laboratory to determine subsurface conditions and make recommendations regarding tunneling, embedment, backfill and excavation parameters. The geotechnical analysis will include the following: o Subsurface exploration including an additional one (1) for a total of fourteen (14) sample bores, at various locations and depths along the proposed line. o Laboratory tests for classification purposes and strength characteristics. o Engineering services that address soil and groundwater conditions for proposed horizontal boring locations. o Update the existing geotechnical report that presents the results of the field and laboratory data as well as analysis and recommendations. The data contained in the geotechnical report will be made available to contractors during the bidding process for information purposes. 60% Plans The Engineer will prepare 60% plans and easement boundaries for the reuse water line. Plans will consist of: o An additional two (2) Plan (only) Sheets at for a total of thirteen (13) Opinion of Probable Construction Cost (OPCC) The Engineer will prepare an opinion of probable construction cost for the project. The Engineer has no control over the cost of labor, materials, equipment, or over the Contractor's methods of determining prices or over competitive bidding or market conditions. Opinions of probable costs provided are based on the information known to Engineer at the time and represent only the Engineer judgment as a design professional familiar with the construction industry. The Engineer cannot and does not guarantee that proposals, bids, or actual construction costs will not vary from its opinions of probable costs. Task Deliverables: o One (1) hard copy and a PDF of the 8-inch reuse water line 30% plans and OPCC Task Meetings o One (1) constructability and routing field visit with the Project Manager and City Arborist, to review the proposed 8-inch alignment. Task 4 Final Design (90%/100%) Plans The Engineer will prepare plans for the water line. These plans will be prepared on Plans will consist of: o Updated Cover Sheet o Updated Project Notes and Sheet Index (2 Sheets) o Updated Project Control and Layout (1 Sheet) o Updated Project Access Plan and Recommended Sequencing (2 Sheets) o An additional two (2) Plan and Profiles Sheets at for a total of thirteen (13) B-4 o An additional one (1) Erosion Control Plan Sheet for a total of seven (7) Opinion of Probable Construction Cost (OPCC) The Engineer will prepare an opinion of probable construction cost for the project. The Engineer has no control over the cost of labor, materials, equipment, or over the Contractor's methods of determining prices or over competitive bidding or market conditions. Opinions of probable costs provided are based on the information known to Engineer at the time and represent only the Engineer judgment as a design professional familiar with the construction industry. Task Deliverables: o Three (3) hard copies and a PDF of the 8-inch water reuse line 100% plans and OPCC Task 5 Easements and Permitting (Optional) Permitting o Environmental Services for 1,220 LF of 8-inch water reuse line extension to 24-inch reuse water line Phase I. (Sub-Consultant Environmental Research Group, LLC.) Archaeological survey and clearance through the Texas Historical Commission, if needed. Task A: Wetland/Water of the US Delineation & Permitting Evaluation The Sub-Consultant will evaluate water features within the project area to determine whether they fall under the jurisdiction of Section 404 of the Clean Water Act (CWA) and, if so, what permitting requirements would apply to discharges into those jurisdictional waters of the U.S. (WOTUS). Any wetlands in the project area will be delineated by a qualified wetlands specialist in accordance with the U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual and the Great Plains Regional Supplement to the manual. The Sub-Consultant will produce a Wetland and WOTUS Delineation Report identifying jurisdictional WOTUS, including any wetlands delineated, and addressing potential permitting of discharges into these jurisdictional waters. The Delineation Report will include maps and photographs of any B-5 such jurisdictional waters identified. A geospatial file of jurisdictional waters will be provided. Task B: Threatened and Endangered Species Habitat Assessment In conjunction with site visit for Task A, Sub-Consultant will assess the likely presence or absence of Threatened and Endangered Species or other species of concern. The Sub-Consultant will produce a Threatened and Endangered Species Habitat Assessment Report identifying Threatened and Endangered Species and other species of concern listed by TPWD and USFWS for Williamson County and describing their habitats. Any area in which activities may impact potential habitat for any such species will be identified. The report will include maps and photographs of any habitats identified Included for 8-inch reuse water line extension to 24-inch reuse water line Phase I. Task C: Above-Ground Resources Desktop Study and Coordination Sub-Consultant will consult relevant available desktop-level significant above-ground historic resources. The Sub-Consultant will summarize findings and prepare a letter for the Texas Historical Commission for their review under the Antiquities Code of Texas. Included for 8-inch reuse water line extension to 24-inch reuse water line Phase I. Task D: Archeological Survey This task is optional based on the results of the project coordination with the THC. If a survey is recommended for all or a portion of the project area, the following will occur: o Prior to archaeological survey, Sub-Consultant will acquire a Texas Antiquities Permit from the THC and conduct a 100 percent pedestrian survey of the project area in accordance with the published minimum survey standards for Texas (CTA 2020). Tests will be approximately 30cm in diameter and will be dug to 80cm below the surface or to bedrock or pre-cultural deposits, whichever is higher. All excavated soil will B-6 be screened, and any artifacts will be recorded and reburied. All sites will be photographed, mapped, fully recorded, and field assessed for NRHP and/or SAL eligibility. o Following field survey, Sub-Consultant will prepare a report summarizing results of the investigations, describing, and evaluating any archaeological sites, mapping their locations, and making recommendations. The survey report will be submitted to the THC for review. The Sub-Consultant will comply with administrative terms of the permit for project completions. The report and all accompanying field documentation will be curated at a State approved facility. Included for 8-inch reuse water line extension to 24-inch reuse water line Phase I. Task E: Summary of New Studies Sub-Consultant will provide approximately two to three paragraphs summarizing the new studies and documentation for the proposed extension. The summary will reference the existing Environmental Assessment and will include new data from Tasks A-D, prime farmlands, and a statement of whether the results of the new studies are consistent with the findings of the EA. Included for 8-inch reuse water line extension to 24-inch reuse water line Phase I. Assumptions Permitting through a nationwide permit Permit preparation will begin after approval of the conceptual design. Improvements will within 50-foot evaluation area for the 8- inch reuse water line extension.
