R- 00- 01- 13 -10F6 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with Rodriguez & Huggins, Inc. for engineering services for improvements to McNeil Road at County Road 172, and WHEREAS, Rodriguez & Huggins, Inc. has submitted Supplemental Agreement No. 3 to the Contract to provide construction inspection services, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 3 to the Contract with Rodriguez & Huggins, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 3 to the Contract with Rodriguez & Huggins, Inc., a copy of said supplemental agreement being attached hereto and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. STLUKA, ., Mayor City of Round Rock, Texas THE STATE OF TEXAS § THE COUNTY OF WILLIAMSON § SUPPLEMENTAL AGREEMENT NO. 3 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Rodriguez & Huggins, Inc., hereinafter called the "Engineer ". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract," on the 27` day of March, 1997 concerning McNeil Road at CR 172. WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires termination of the Contract on March 31, 1998 unless the Contract is extended, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $67,237.62 without modification of the contract, and WHEREAS, it has become necessary to amend the contract to provide for a change in the scope of services to include construction inspection and management services, and WHEREAS, it is in the City's best interest to extend the term of the Contract until July 1, 2000, and WHEREAS, the Engineer has agreed to perform the additional work for $91,268.10 increasing the lump sum fee for the contract to $158,505.72. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD, shall be extended until July 1, 2000. ARTICLE 4, COMPENSATION shall be amended by changing the lump sum amount payable under this contract to $158,505.72. ATTACHMENT "B ", Services to be Provided by the Engineer shall be amended as set forth in the attached ADDENDUM NO. 1 to ATTACHMENT B. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 3 to the Rodriguez & Huggins contract for McNeil Road and CR 172 to provide construction inspection services. On December 16, 1999, the City Council approved the award of the construction contract with Aaron Concrete Company for improvements at the intersection of McNeil Road and CR 172. This project is funded in part by Federal Funds and requires inspection schedules, record keeping, and the reports that are different from our normal City procedures. It is in the City's best interest to hire the construction inspection services through our engineering consultant who is experienced in managing federal transportation projects.
