RESOLUTION NO. R- 00- 03- 23 -13A5 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with Carter & Burgess, Inc. for the preparation of schematics, environmental documents, right of way documents, plans, specifications, estimates, and contract documents for the reconstruction of US 79 as a four -lane divided highway from CR 195 to CR 110, and WHEREAS, Carter & Burgess, Inc. has submitted Supplemental Agreement No. 2 to the Contract to provide for additional work required by the Texas Department of Transportation, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 2 to the Contract with Carter & Burgess, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 2 to the Contract with Carter & Burgess, Inc. to provide for additional work required by the Texas Department of Transporation, a copy of said supplemental agreement being attached hereto and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the K: \wvmcs \Rasozvrx \Ra o323A5 W.M /sc public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. ATTEST: m rna) ci L- E LAND, City Secretary 2 City of Round Rock, Texas STATE OF TEXAS COUNTY OF WILLIAMSON § SUPPLEMENTAL AGREEMENT NO. 2 Contract No. TO CONTRACT FOR ENGINEERING SERVICES This amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Carter & Burgess, Inc., hereinafter called the "Engineer ". WHEREAS, the City and the Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 22n day of December, 1998 concerning the reconstruction of US 79 from County Road 195 to McNutt Creek East of County Road 110; and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract; and WHEREAS, ARTICLE 3, CONTRACT PERIOD, establishes the termination date of the Contract to be at the close of business on December 31, 1999; and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $504,915 without modification of the Contract; and WHEREAS, it has become necessary to amend the contract to provide for a change in scope of services to include the preparation of plans, specifications, and estimates for the landscaping and irrigation design on US 79 from County Road 195 to County Road 122; and to compensate the Engineer for this increased work through the payment of an additional $51,690; and WHEREAS, the Engineer has agreed to perform the additional work for $51,690 increasing the lump sum fee for the Contract to $556,605. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD, shall be amended by changing the termination date to be at the close of business on August 31, 2000. ARTICLE 4, COMPENSATION shall be amended by changing the lump sum amount payable under this contract to $556,605. The Irrigation water source will be the effluent transmission line that crosses US 79. The pipe will be tapped, and will be assumed to have sufficient pressure to run the system without booster pumps. Pump design will be considered additional services. 2. The limits of work extend from County Road 122 to the Old Settlers Park Entrance Road (approximately 6800 feet along US 79 end 300 feet along Old Settlers Park Entrance Road). 3. The gateway monument will be located on north side of US 79 right of way, adjacent to the Chandler Creek crossing. The monument will be placed on property previously acquired by the City. 4.
