Subject: Property Donation to PD
A Mr. John Lewis called at this time. He has a 54 -acre tract of land with an empty farmhouse on
it. If you are going East on 79, it's just past 1460 on the North side of 79. He said it's the old
Warner Farm. There are no neighbors.
He would like to donate it first to the PD for training purposes. He mentioned that it could be used
for SWAT or K -9 or whatever the Command Staff thought was appropriate. When the PD Is
finished with it, he's going to let the Fire Department use it for training and it sounded like they
could burn it down.
He wants to know if we are interested in this and if so, whom would he contact?

WHEREAS, 54 ACRE LTD, a Texas limited partnership, has authorized
the City of Round Rock to enter upon it's property for the purposes of
conducting police and fire - related training activities, and
WHEREAS, the City wishes to execute a Release to hold harmless
54 ACRE LTD from any liability arising out of or in connection with the
City's use of the property, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a Release to hold harmless 54 ACRE LTD from any
liability arising out of or in connection with the City's use of the
property, a copy of which is attached hereto and incorporated herein
for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

The City of Round Rock, Williamson County, Texas (hereinafter "CITY "), in consideration of
54 Acre Ltd., a Texas limited partnership (hereinafter "54 ACRE LTD "), authorizing the CITY to enter
upon 54 ACRE LTD's property more particularly described on Exhibit A, attached hereto and a part
hereof (hereinafter "PROPERTY ") for the purposes of conducting police and fire - related training
activities on said PROPERTY, the receipt of which consideration is acknowledged, agrees to and shall
hold harmless 54 ACRE LTD, its officers, agents, and employees, from and against any and all claims,
losses, damages, causes of action, suits and liability of every kind, including all expenses of litigation,
court costs, and attorney's fees, for injury to or death of any person, or for damages to any property,
arising out of or in connection with CITY's use of the PROPERTY.
CITY assumes full responsibility for the police and fire- related training activities of CITY held
on the PROPERTY, and hereby releases, relinquishes, and discharges 54 ACRE LTD, its officers, agents
and employees, from all claims, demands, and causes of action of every kind and character including the
cost of defense thereof, for any injury to, including death of, any person and any loss of or damage to
property caused by, arising out of, or in connection with CITY's use of the PROPERTY for police and
fire- related training activities.
54 ACRE LTD understands and agrees that CITY may construct and erect training structures and
facilities on the PROPERTY consistent with the use of the PROPERTY for police and fire training
activities. CITY will be responsible for the improvement and maintenance of the police and fire- related
training facilities situated on the PROPERTY. CITY agrees to promptly remove any improvements
and /or training facilities it constructs on the PROPERTY and to cease using the PROPERTY within
thirty (30) days of written of notice from 54 ACRE LTD to do so. Such written notice shall be given to
Robert A. Stluka, Jr., Mayor, and Paul Conner, Chief of Police, City of Round Rock, 221 E. Main Street,
Round Rock, Texas 78664.
