The Round Rock City Council approved Resolution No. R- 00- 08- 24 -10A2 at their
regularly scheduled meeting on August 24, 2000. This resolution approves the Letter of
Agreement for a vanpool program.
Enclosed is a copy of the resolution and agreement for your files. If you have any

RESOLUTION NO. R- 00- 08- 24 -10A2
WHEREAS, Chapter 791 of the Texas Government Code, V.T.C.A.,
authorizes local governments and agencies of the state to enter into
agreements with one another to perform governmental functions and
services, and
WHEREAS, the City of Round Rock wishes to enter into a Letter of
Agreement with Capital Metro for a vanpool program which would help
reduce air pollution and ease traffic congestion, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City said Agreement, a copy of same being attached hereto
and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

RE: Vanpool Services Agreement
Dear Mayor Stluka,
We have been recently approached by a group of Round Rock residents that have expressed an
interest in starting a vanpool within your region. Vanpools are groups of 6 to 10 commuters who share
common home origins and work destinations. One person from the group volunteers to be the primary
driver. In return Capital Metro provides the vehicle, insurance, preventive maintenance and fuel for the
commuters. This program has many benefits for the region including; reducing single occupant vehicles,
which helps reduce traffic congestion, and provides for improved air quality. The cost of the program is
somewhat higher than the traditional cost of the in- service area vanpool program and requires Capital Metro
to recover 100% of the operating cost from drivers /members.
The City of Round Rock and Capital Metro are authorized to enter into a Letter of Agreement
( "Agreement ") pursuant to the provisions of the Interlocal Cooperation Act, Texas Government Code,
§791.001 et seq., Chapter 451 of the Texas Transportation Code, provides that Capital Metro may contract
with a municipality for the authority to provide public transportation services outside of its territory. This
vanpool program will benefit both parties in reducing air pollution and easing traffic congestion.
The City of Round Rock will not be obligated to provide any subsidy for the vanpool program and
this Agreement will not obligate the City of Round Rock to any financial terms or conditions. All costs are
the responsibility of the vanpool participants. It is hoped the city of Round Rock will consider allowing
Capital Metro the opportunity to provide this valuable service to your region.
Please provide your signature and the date on both originals in the space provided below if you
agree to the terms and conditions of this Agreement. Keep one original Agreement for your files and return
one original to me at the address listed on this letterhead.
This Agreement will automatically renew annually unless either party sends a notification, via
certified mail, with or without cause upon thirty (30) days written notices to the other party. Should you

Dear Nancy,
In response to your questions concerning the Vanpool Service Agreement, I have provided
the following answers.
Question: Why is it necessary for the City of Round Rock to enter into a letter of
agreement with Capital Metro. Since the agreement is with the Round Rock resident,
why isn't the resident required to sign the agreement?
Answer: Pursuant to the provisions of the Interlocal Cooperation Act, Texas
Government Code, 791 .001 et seq., Chapter 451 of the Transportation Code, Capital
Metro may contract with a "Municipality" for the authority to provide public
transportation services outside of its service territory. Since the City of Round Rock is
outside of our service territory it requires us to receive your approval to operate our
vanpool service. I will be glad to send you a copy of the transportation code if needed.
Question: Does the City of Round Rock have any financial or non - financial obligations
under this agreement?
Answer: The City of Round will have absolutely no financial or non - financial
obligations under this agreement. When a vanpool driver is approved to operate one of
our vanpool vehicles he /she must sign a member agreement with Capital Metro. I can
provide you with a copy of this agreement if needed.

Question: Was the City of Pflugerville required to sign a letter of agreement with Capital
Metro for the express bus service?
Answer: When Pflugerville citizens voted to pull out of the Capital Metro service area
we discontinued providing express service within the city limits of Pflugerville. The
current express service that operates from the HEB Park N Ride lot at 1825 is located in
Travis County Precinct 2, which is considered Austin City limits. Therefore, there is no
letter of agreement required. However, the city of Pflugerville was sent the same letter
you received due to numerous requests of individuals residing within Pflugerville city
Limits inquiring about starting vanpools.
I hope these answers will help clarify Capital Metro positions on the out of service area
vanpools. Our vanpool program provides many benefits both, to your residents and our
