WHEREAS, the City of Round Rock has previously entered into a
contract for engineering services ( "Contract ") with Rodriguez &
Huggins, Inc. to establish the alignment of A.W. Grimes Boulevard from
US 79 to south of Louis Henna Boulevard, preparation of a schematic,
and preparation of right -of -way documents, and
WHEREAS, Rodriguez & Huggins, Inc. has submitted Supplemental
Agreement No. 3 to the Contract to provide for additional surveying
services, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 3 to the Contract with Rodriguez & Huggins, Inc., Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 3 to the Contract with
Rodriguez & Huggins, Inc., a copy of said supplemental agreement being
attached hereto and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted

upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

SUPPLEMENTAL AGREEMENT NO. 3
TO CONTRACT FOR ENGINEERING SERVICES
This Amendment to the Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Rodriquez &
Huggins, Inc., hereinafter called the "Engineer ".
WHEREAS, the City and Engineer executed a Contract for Engineering Services,
hereinafter called the "Contract ", on the 13 of May, 1999 to establish the align-
ment of Arterial B from US 79 to South of Louis Henna Boulevard, prepare a
schematic, and prepare right of way documents of critical parcels, and
WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY
ENGINEER, describes those engineering services to be provided by the Engineer
as a part of the Contract, and
WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump
sum payable under this contract at $1,302,198.82 without modification of the con-
tract, and
WHEREAS, it has become necessary to amend the contract to provide for (1) a
change in the scope of services at zero costs to produce the plan set for inclusion in
the Texas Turnpike Authority (TTA) letting package, (2) additional costs for sur-
veying services to be provide by SAM, and (3) additional costs for conversion of
existing FEMA model by Epsey, Padden Consultants, Inc., and
WHEREAS, the Engineer has agreed to have the additional work performed for
$16,235.00 increasing the lump sum fee for the contract to $1,318,433.82.
NOW THEREFORE, premises considered, the City and the Engineer agree that
said Contract is amended as follows:
ARTICLE 4, COMPENSATION, shall be amended by the changing the lump sum
amount payable under this contract as $1,318,433.82.
ATTACHMENT "B ", Services to be Provided by the Engineer shall be amended
as set forth in the attached ADDENDUM NO. 2 to ATTACHMENT B.
IN WITNESS WHEREOF, the City and the Engineer have executed Supple-
mental Agreement in duplicate.

The City of Round Rock will furnish to the Engineer the following items /information:
RIGHT -OF -WAY (ROW)
1. Assist in the utility coordination process.
FIELD SURVEYING
1. Provide all survey information to date.
ROADWAY DESIGN CONTROL
1. Design speed and specific criteria for project design.
2. Coordination necessary to secure typical section and preliminary design approval.
3. Develop proposed pavement sections /designs.
DRAINAGE DESIGN
1. Provide available information on existing drainage facility.
2. Hydraulic design criteria for project design.
3. Provide standard details as necessary.
SIGNING, PAVEMENT MARKINGS AND SIGNALIZATION
1. Provide standard detail as necessary.
MISCELLANEOUS (ROADWAY)
1. Coordinate and host utility coordination meetings.
2. Prepare and coordinate any Utility Agreements required.
EXHIBIT B
SERVICES TO BE PROVIDED BY THE ENGINEER
The work effort and the management for the project included in this contract will be conducted in
the Engineer's office in Austin, Texas. The Engineer will be readily accessible to the City of
Round Rock staff, Texas Tumpike Authority (TTA) staff, the managing General Engineering
Consultant (GEC) and other Prime and Sub - Providers. The Engineer shall coordinate closely
with TTA staff, GEC and other Prime and Sub - Providers involved in the proposed project
development. At a minimum, monthly progress reports will be submitted, which will detail on-
going work as well as work accomplished since the previous report. A memorandum
documenting progress meetings will be prepared by the Engineer.
The Engineer shall prepare construction plans and documents for inclusion with other plans and
documents prepared by other Engineers selected by TTA. The resulting merged plan set will be
processed by TTA as one document and let to contract by Texas Department of Transportation
( TxDOT).
When feasible, TxDOT or TTA standard drawings, and specifications of previously approved
special provisions /specifications will be utilized. If a special provision or special specification
must be developed under this contract, it shall be in the above format, and, to the extent possible,
incorporate references to TxDOT's approved test procedures.
All work is subject to the review and approval of TTA. For those items which require
preliminary approval, a special designation for preliminary submission is noted in the following
list of services to be provided.
The plan sheets specified in the following list of tasks will adhere in format and content to
example sheets provided by the TTA's Project Manager. Specific project items not adequately
addressed on the example sheets should be discussed with the TTA's Project Manager. To
minimize revisions, the Engineer should request sample copies of any sheets /schematics/etc. for
clarification.
The Engineer will solicit and secure written permission for entry to accomplish any work beyond
the existing right of way. The Engineer is fully responsible for any traffic control required from
any data collection activities. The control must be consistent with the TxDOT procedures. The
Engineer may not close a lane of traffic without the written approval of the TTA's Project
Manager. All survey work shall be done in accordance with Texas Board of Professional
Surveyors "Manual of Practice for Land Surveying."
The Engineer shall provide the following engineering services required for the preparation of the
plans, specifications and estimate (PS &E).
PRELIMINARY DESIGN STUDIES
1. Collect and review all available data.
2. Develop a design schematic on controlled planimetrics and ortho - photography.
PUBLIC INVOLVEMENT
1. Prepare public meetings displays and exhibits, as required.
RIGHT -OF -WAY (ROW)
1. Participate in the utility coordination process.
2. Develop proposed ROW requirements for Arterial B.
FIELD SURVEYING
1. Establish two (2) permanent bench marks for the project.
2. Provide ties to existing property corners and right of way points.
3. Provide ties to planimetric features. Provide DGN mapping file.
4. Tie and profile existing drainage facilities and cross section natural drainage features as
needed.
5. Provide ties to existing underground and overhead utilities, as needed.
6. Set horizontal and vertical control.
7. Provide natural ground cross - sections at 50 feet intervals.
ROADWAY DESIGN CONTROL
1. Refine the horizontal and vertical alignment of roadways.
2. Provide design cross - sections.
3. Compute earthwork quantities.
4. Prepare typical sections.
5. Develop plan /profile sheets.
6. Develop intersection/driveway details.
7. Miscellaneous roadway details.
DRAINAGE DESIGN
1. Prepare drainage area maps showing existing conditions and proposed improvements.
2. Prepare hydraulic computations for culverts, channels, storm sewer and inlets.
3. Prepare hydraulic data sheets.
4. Develop storm sewer plan/profile and culvert cross section sheets.
5. Develop miscellaneous drainage details.
6. Summary of quantities for drainage items.
7. Develop SW3P plans per phase consistent with the TCP.
8. Prepare SW3P quantities and summaries.
SIGNING , PAVEMENT MARKINGS AND ILLUMINATION
1. Prepare signing and pavement markings layout:

MISCELLANEOUS (ROADWAY)
1. Develop Traffic Control Plan (TCP), Detours, and Sequence of Construction layouts.
A detailed TCP shall be developed utilizing the MUTCD and the current TxDOT
Barricade and Construction Standards. Each phase should identify the existing and
proposed traffic control devices that will be used to handle traffic during each sequence
of construction, including regulatory signs, warning signs, construction warning signs,
guide signs, route markers, construction pavement markings, channelizing devices,
portable changeable message signs, flashing arrow boards, barricades, barriers, etc.
2. Prepare a narrative of the construction sequencing.
3. Prepare phasing quantities and summaries.
4. Prepare exhibits for utility agreements.
5. Prepare miscellaneous details as required
6. Prepare estimate, specifications and general notes.
7. Prepare special specifications as required for non - standard items.
8. Prepare cost estimate.
9. Prepare construction time estimate.

Attached is a letter from SAM, Inc. detailing additional costs associated with the above
referenced project. These services are not included in the current contract, but are
necessary to completion of the PS &E package. The fees have been reviewed by R&H
and we feel that they are justified.
As we discussed, please combine this request with the previously submitted Espey
Padden supplemental estimate into one contract adjustment.

The above referenced project includes the proposed Brushy Creek crossing and
associated hydraulic analysis. During the course of project development, we discovered
that the existing FEMA model was coded in WSP -2 format and required conversion into
HEC -RAS format.
This conversion was something that was not scoped in the contract and not something we
were equipped to handle ourselves. With your knowledge, we contracted Espey, Padden
Consultants, Inc. (EPC) to accomplish this conversion, update the converted HEC -RAS
model to include new survey data and develop the proposed conditions model at Brushy
Creek.
This has proven to be a very prudent addition to the R &H team; however, we never
requested supplemental fees from the City to cover this additional work performed by
EPC. A subsequent Supplemental Agreement was approved by the City for EPC to
accomplish the same scope at Lake Creek , Dry Branch Trib 1, and Dry Branch.
We respectfully request, at this late date, that a Supplemental Agreement be approved to
increase the contract by $5,735.00 to cover the above detailed costs at Brushy Creek.

Dear Mike:
We have revised our additional services estimated fees as per our meeting on June 13, 2000. Per your request, SAM,
Inc. will provide the following additional services with estimated fees as shown below.
I. Due to the realignment on the Jennings and Hoover tracts we had to set, locate, and elevate an additional five
aerial targets. The cost to perform this task is $3,000.00.
II. The cost to perform a level loop from the FEMA benchmarks on Gattis School Road that you have outlined on
your fax dated June 20, 2000 to our existing vertical control for Arterial B will be $2,100.00. We will provide
you with the difference in elevation between the two datums for both the north and south ends of the project.
III. SAM, Inc. field survey personnel (as differentiated from a qualified arborist) will tag and locate all trees 8 -inch
(diameter breast high) and greater for the approximate 4 acre right -of -way tract that is within the M&M
Equities IV, Inc. tracts. Using the formula of 1 foot of crown radius for each inch of trunk diameter, the
calculated canopy for all located trees will be shown. A tree list with tag numbers, tree diameter and species
(common name) in an ASCII file, and a working dgn file with hardcopy will be delivered. The cost for this
task will be $5,400.00.
