WHEREAS, the U.S. Department of Housing and Urban Development
( "HUD ") has grant funds available to cities through the Community
Development Block Grant Program, and
WHEREAS, the City Council wishes to make application for the
available grant funds for specific projects and activities identified
in the Fiscal Year 2000 -2001 Action Plan that was adopted by the City
Council on August 10, 2000, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a Funding Approval /Agreement with HUD for the above -
described grant, a copy of said Approval /Agreement being attached
hereto and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

Grant Agreement
This Grant Agreement between the Department of Housing and Urban Development (HUD) and the above named Grantee is made
pursuant to the authority of Title I of the Housing and Community Development Act of 1974, as amended, 142 U.S.C. 5301 et seq).
The Grantee's submissions for Title 1 assistance, the HUD regulations at 24 CFR Part 570 (as now in effect and as may be amended
from time to time), and this Funding Approval, including any special conditions, constitute part of the Agreement. Subject to the
provisions of this Grant Agreement, HUD will make the funding assistance specified here available to the Grantee upon execution of
the Agreement by the parties. The funding assistance specified in the Funding Approval may be used to pay costs incurred after the
date specified in 4 above provided the activities to which such costs are related are carried out in compliance with all applicable
requirements. Pre - agreement costs may not be paid with funding assistance specified here unless they are authorized in HUD
regulations or approved by waiver and listed in the special conditions to the Funding Approval. The Grantee agrees to assume all of
the responsibilities for environmental review, decision making, and actions, as specified and required in regulations issued by the

Executive Order 12372 - SPECIAL CONTRACT CONDITION
Notwithstanding any other provision of this agreement, no funds provided under this
agreement may be obligated or expended for the planning or construction of water or
sewer facilities until receipt of written notification from HUD of the release of funds on
completion of the review procedures required under Executive Order (E.O.) 12372,
Intergovernmental Review of Federal Programs, and HUD's implementing regulations at
24 CFR Part 52. The recipient shall also complete the review procedures required under
E.O. 12372 and 24 CFR Part 52 and receive written notification from HUD of the release
of funds provided under this agreement for any new or revised activity for the planning or
construction of water or sewer facilities not previously reviewed under E.O. 12372 and
implementing regulations.

This is to inform you that we have completed our review of the City's FY 2000-
2001 Action Plan. In our review of your plan, we have taken into consideration the five -
year goals outlined in the Consolidated Plan and compared it to your one -year goals, as
specifically identified in the Action Plan. As a result of our review and analysis, we have
determined that your proposed activities for the ensuing Program Year (PY) are
generally consistent with the Five Year Consolidated Plan. However, we are requesting
additional information on several of the activities you have proposed to undertake for
the upcoming program year.
• Buck Eggers Park - Please provide specific information on what type of
improvements will be made to the park. In addition please delineate the boundaries
of the service area, the basis for determining those boundaries and the percentage
of low and moderate income persons in the service area.
• Technical Training - We will need additional information on what this activity entails.
As stated in the Listing of Proposed Projects, this activity will be creating 20 jobs. It
is unclear as to how these positions will be created. Your clarification of this
proposal is being requested.
• Land Acquisition - Please follow the pertinent regulations in the purchase of all land,
document every transaction and keep in your files for future reference.
• Public Services - Please identify the specific public services that will be provided.
Please be advised that in order for a public service to be eligible for funding, the
service being provided must be a new service or a quantifiable level of increase over
what has previously been provided and the expenditure cap is 15 %. We are
requesting you provide our office with your basis and determination of eligibility for
this activity.

In our analysis of your Consolidated Plan and Action Plan, we note that in the
Funding Distribution for CDBG Activities for PY 2000 -2001, Neighborhood Enhancements
comprises only 3% of your Community Development Block Grant (CDBG) program.
However, the Neighborhood Enhancements Program under the Community
Development Five -Year Strategic Plan is shown as a priority for the community. As a
result, we strongly encourage the City to initiate the planning process to utilize future
CDBG funds in areas of demonstrated need. Of the seven targeted areas identified for
CDBG assistance, the City has worked in only Census Tracts 207.013 & 215.034. Our
basis for this recommendation is highlighted below:
As stated in your Consolidated Plan, the City has 1,900 single family units which
are need of some form of assistance. For example, the data in your Plan, identifies 115
units as conservable (in need of repair); 82 are substandard (one or more code
violations and require professional maintenance or replacement); and 28 are
dilapidated. The following table will illustrate the need by Census Tract (Single Family
structures only):
By contrast, the following table will further illustrate the need for CDBG
assistance:

Please note that Census Tracts 205.043 and 206.021 have a low moderate
income population of 41.9% and 42.9 %, respectively. When considering these areas
for assistance in the area of housing, please remember that only those individuals and
households with 80% of the City's median income remain eligible to participate in the
Block Grant program. In addition, please note that the City's Exception Criteria (i.e.,
Low and Moderate income benefit threshold) is 48.1 %. Any census tract above this
threshold is eligible for program assistance.
The following table will provide you with a general summary of the physical condition of
the City's housing stock.
Based on the information you have provided and our analysis of this data, we
feel very strongly in having the City consider the use of future Block Grant funds in the
areas of locally demonstrated need as specifically shown above.
Since the City is entering the second full year of operation, bringing this matter
to your attention at this early stage, should allow you ample time to review all of your
goals and objectives and to plan accordingly.
Enclosed you will find funding approval contracts and \or grant agreements for
the City's Community Development Block Grant Program in the amount of $433,000.
Please execute the attached documents and return two copies of each document
to our office. As you review each document, please note any special conditions and \or
program reminders for Community Development Block Program. The special condition
in your Grant Agreement and Funding Approval concerning the review procedures under
Executive Order 12372, restricts the obligation or expenditure of funds for the planning
or construction of water or sewer facilities, until the completion of the environmental
review process and receipt of written notification of release of funds from our Office. In
the event that you need to amend your Action Plan to use funds for the planning or
construction of water or sewer facilities, you must receive written release of funds for
such activities.

We want to reinforce the importance of maintaining a good local grants
management system, i.e., record keeping for all on -going activities, financial records,
procurement, environmental, and other pertinent CDBG documents, which will serve to
substantiate your achievement of locally identified goals. In addition, this type of
documentation, along with the input of program data into the Integrated Disbursement
& Information System (IDIS) will serve to confirm program compliance with the rules
and regulations. Furthermore, we suggest that you maintain a file of all local program
monitoring conducted throughout the year. As to form, your local grants management
system can be set up as you desire. The key to having a workable CDBG program
compliance system is to keep track of all milestone achieved, expenditure balances, data
input into the IDIS system, and local program monitoring of all technical areas. This
information is necessary for the preparation of annual end of the year reports to local
citizens and the Department.
We want to remind you that certain activities are subject to the Environmental
Review Procedures for the CDBG program, otherwise known as 24 CFR Part 58. Funds
for such activities may not be obligated or expended unless there is a written Release of
Grant Funds from our Office.
Please note that your upcoming Consolidated Annual Performance Evaluation
Report (CAPER) is due on December 31, 2000. The purpose of this report is to show
what you have accomplished with CDBG funds and other leveraged funds during the
previous Program Year and allows the Department, local officials, and the public to
arrive at conclusions conceming the City's overall performance. To that end, your staff
should be inputting data into the IDIS system on a quarterly basis in order for the IDIS
generated reports to produce a complete CAPER and annual performance record.
The Department views your approved submission as a living planning document
which will allow you the flexibility to respond to changing needs in a thoughtful and
coordinated manner.
