WHEREAS, Chapter 791 of the Texas Government Code, V.T.C.A.,
authorizes local governments and agencies of the state to enter into
agreements with one another to perform governmental functions and
services, and
WHEREAS, the City of Round Rock wishes to enter into an
Interlocal Agreement with Williamson County for the construction of
hike and bike trails in Old Settlers Park at Palm Valley, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City said Agreement, a copy of same being attached hereto
and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

THIS INTERLOCAL AGREEMENT is made and entered into effective this /G day of
., 2000 (the "Effective Date "), by and between WILLIAMSON COUNTY (the "County ") and
the CITY OF ROUND ROCK, TEXAS (the "City "), political subdivisions of the State of Texas.
WITNESSETH:
WHEREAS, V.T.C.A., Government Code, Chapter 791, the Texas Interlocal Cooperation Act,
provides that any one or more public agencies may contract with each other for the performance
of governmental functions and for the joint use of facilities or services for the promotion
and protection of the health and welfare of the inhabitants of this State and the mutual
benefit of the parties; and
WHEREAS, each of the parties hereto desire to provide for the construction of hike and
bike trails within Old Settlers Park at Palm Valley for the use of the citizens of Williamson
County; and
WHEREAS, the City of Round Rock currently has the land available to dedicate to a hike
and bike trail and recognizes that this joint effort will result in a cost effective project;
NOW, THEREFORE, in consideration of the mutual covenants and agreements herein
contained, the undersigned parties agree as follows:
TERMS AND CONDITIONS
1. The City hereby agrees to construct and maintain hike and bike trails within Old
Settlers Park at Palm Valley and make said trails available to the general public of
Williamson County at no fee.
2. As consideration for the above, Williamson County will transfer Two Hundred and Fifty
Thousand and No/ 100 Dollars ($250,000) to the City within 45 days after the Effective
Date of this agreement.
1. The parties agree that in the event any provision of this Agreement is held by a court
of competent jurisdiction to be in contradiction of any laws of the State or the
United States, the parties will immediately rectify the offending portions of this
Agreement. The remainder of the Agreement shall be in full force and effect.
2. This Agreement constitutes the entire agreement between the parties hereto, and
supersedes all their oral and written negotiations, agreements and understandings of
every kind. The parties understand, agree and declare that no promise, warranty,
statement or representation of any kind whatsoever, which is not expressly stated in
this Agreement, has been made by any party hereto or its officers, employees or other
agents to induce execution of this Agreement.

SUBJECT: City Council Meeting — October 12, 2000
ITEM: 10.E.1. Consider a resolution authorizing the Mayor to execute an
Interlocal Agreement with Williamson County for the construction
of hike and bike trails at Old Settlers Park at Palm Valley. The
Williamson County Commissioner's Court approved this agreement
at it's September 18, 2000 meeting, which grants the City $250,000
to help construct approximately 3 miles of trail. Staff Resource
Person: Sharon Prete, Parks and Recreation Director.
History: The County has offered to fund trail construction in Old Settlers
Park at Palm Valley if the City would maintain the trails.
Cost: $250,000 grant from Williamson County. City maintenance cost is
minimal.
