R- 98- 11- 24 -14C1 TO CONTRACT FOR ENGINEERING SERVICES This supplemental agreement to contract for engineering services is made by and between the City of Round Rock, 221 E. Main St, Round Rock, Texas 78664, hereinafter called "City" and Earth Tech Transportation Services. Inc., having its principal business address at 811 Barton Springs Road, Ste. 400, Austin, TX 78704, hereinafter called "Engineer" for the purpose of contracting for engineering services. WHEREAS, the State and the Engineer executed a contract on the 24th of November, 1998 concerning the preparation of schematics, environmental documents, right of way documents, plans, specification, and estimates for the realignment of South Mays Street, Dell Way, Hester's Crossing, and the extension of Gattis School Road from South Mays Street to the IH 35 East Frontage Road; and, WHEREAS, Article 3, Contract Period, requires work to be completed on or before September 30, 2000; and, WHEREAS, Article 4, Compensation limits the maximum amount payable of the contract to $294,000.00; and, WHEREAS, Article 5, Method of Payment stipulates the payment as a lump sum fee invoiced monthly on a percentage completed basis; and, WHEREAS, it has become necessary to amend the contract to terminate engineering services for the Mays Street realignment at Hester's Crossing; and, WHEREAS, it has become necessary to amend the contract to provide for Project Representative services on the construction of Dell Way, Gattis School Rd., Dell Center Blvd., and the Home Depot Bridge; and, WHEREAS, it has become necessary to amend the contract to extend the termination date to December 31, 2001; and, WHEREAS, it has become necessary to amend the contract to revise the method of payment to time and material basis not to exceed the amount of this supplemental. NOW THEREFORE, premises considered, the City and the Engineer agree that said contract is amended as follows: 1. Terminate engineering services for the Mays Street realignment at Hester's Crossing; and, 2. Provide for Project Representative services on the construction of Dell Way, Gattis School Rd., Dell Center Blvd., and the Home Depot Bridge as identified in Attachment B Services to be Provided by the Engineer; and, 3. Article 3, Contract Period, is revised from September 30, 2000 to December 31. 2001; and, 4. Article 4, Compensation, the maximum amount payable for this contract remains at $294,000.00. The maximum not to exceed time and material payment for this supplemental agreement is $40.601.22; and, 5. Article 5, Method of Payment, is revised to change the payment method to time and material basis not to exceed the amount of this supplemental. The Engineer will invoice according to Attachment D Fee Schedule up to the stated limit. Upon reaching the limit, the Engineer will stop perforating unless the City authorizes further work in writing. The Engineer will provide the following services: Project Representative The Engineer will provide a project representative to observe work specifically related to street and drainage construction necessary the complete the project. The Project Representative will provide services for an average of eight (8) hours per week for approximately 34 weeks (240 calendar days). The Project Representative will periodically observe and document project proceedings, review contractor pay estimates and make recommendations to the City of Round Rock and Contractor which will effectively prevent or limit problems related to the work. The Project Representative will not supervise, direct, control or have authority over or be responsible for Contractor's means, methods, techniques, sequences or procedures of construction, the safety precautions and programs incident to the work being performed or any failure of the Contractor to comply with Laws and Regulations applicable to the furnishing or performance of the work. The Engineer will process subconsultant invoices and submit monthly invoices to the City. Shop Drawing Review The Engineer will review and approve shop drawings for the roadway related items necessary for the construction of the project. The Engineer will retain the services of a subconsultant (Fields Engineering Consultants) to review and approve the Home Depot Bridge shop drawings. The subconsultant estimates 40 hours for shop drawing review. Prepare "As Built" Plans The Engineer will prepare "As Built" construction plans of the roadway following the completion of the project. The Engineer will retain the services of a subconsultant (Fields Engineering Consultants) to prepare the "As Built" construction plans for the Home Depot Bridge. The final roadway and bridge plans will be integrated and submitted to the City for its final record. Foundation Construction Observation The Engineer will retain the services of a subconsultant (PSI Engineering) to observe foundation construction activities associated with the Home Depot Bridge. The subconsultant estimates 40 hours of in -field observation based on the Contractor's estimate of 5 days for the construction of the Home Depot foundation. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 1 to Contract for Engineering Services with Earth Tech Transportation Services, Inc., for a change in the scope of services and to extend the contract date for the preparation of schematics, environmental documents, right - of -way documents, plans, specifications, and estimates for the realignment of South Mays Street, Dell Way, Hester's Crossing, and the extension of Galtis School Road from South Mays Street to the HI 35 East Frontage Road. The supplemental agreement adds construction management responsibilities and geotech to the contract services and deletes design responsibilities that cannot be completed because of TxDOT's lack of a schedule for the replacement of the Hester's Crossing Bridge over I -35. No increase or decrease in fee is proposed for these changes. The construction contract was awarded to Austin Filter Systems, Inc. This amendment is necessary to provide needed construction management assistance for this project.
