WHEREAS, the City of Round Rock has previously entered into a
contract ( "Contract ") with Kinsel Industries, Inc. for the Water
Treatment Plant Phase IV Expansion Project, and
WHEREAS,the Council has determined that it is necessary to make
changes to the plans or specifications of the Contract due to
unforeseen circumstances, and to make changes to the quantity of work
to be performed or materials, equipment, or supplies to be provided,
WHEREAS, it has been determined that it is necessary to change
said Contract in accordance with the attached Contract Change Order No.
5, and
WHEREAS,the Council has determined that this Change Order No. 5
will not result in an increase of the original contract price by more
than 25 percent, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Contract Change Order No. 5 to the Contract with
Kinsel Industries, Inc. for the Water Treatment Plant Phase IV
Expansion Project.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

provided This Change Order No. 5 is necessary for the final
completion of this project. It covers unanticipated items that were
discovered during construction and represents necessary changes in
response to conditions found in the field. This Change Order is a net
decrease of $160,934.17, which results in a net decrease of
$136,461.17 to the current contract total. Therefore the final contract
total is $6,176,746.10 for a total increase to the original contract
amount of approximately 2.2 %.

History: This Change Order No. 5 is necessary for the final completion of this project It
covers unanticipated items that were discovered during construction and
represents necessary changes in response to conditions found in the field. This
Change Order is a decrease of $160,934.17.

Impact: Corrects items found during construction that needed repair and/or replacement
Benefit: Is to minimize the potential of critical system failure, which could result in
critical water shortages to our customers.

The original contract amount was $6,046,900.00, with the previous change
orders and contract amendments the contract amount had increased to
$6,337,680.27 a 4.81% increase. With this Change Order No. 5 this amount
will be reduced to $6,176,746.10 or just a 2.15% increase over the original
