WHEREAS, the City of Round Rock, as Grantee, and Sarah J.
Miller, as Grantor, have entered into a Real Estate Contract for the
purchase of approximately 1.49 acres for right -of -way for the A.W.
Grimes Boulevard Project, and
WHEREAS, as part of the consideration of said purchase, the City
has offered to reimburse Sarah J. Miller, for certain reasonable and
necessary relocation and moving expenses, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the City Manager is hereby authorized to reimburse Sarah J.
Miller up to $25,000 for reasonable and necessary relocation and moving
expenses associated with her move from the property.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

Letter Offering Relocation Assistance Payments
to 180 -Day Owner - Occupant
April 5, 2001
We are enclosing a booklet entitled "Relocation Assistance" that explains the procedures
used by the City of Round Rock to assist persons displaced by the purchase of land for
highway right of way. We believe that you will find that this booklet is very helpful.
The payments and services to which you may be entitled through a Relocation Assistance
Program are over and above, and in addition to, the payment you will receive for your
land and/or improvements.
Please take careful note of each and all of the following statements:
1. You will not be required to move from the property being acquired for at least 90
days from the date of this letter. At some later date you will be given a written
notice and a date by which you must vacate the property. You will have at least
30 days after receipt of the written notice before you must move.
2. If you accept $175,000.00 (One Hundred Seventy -Five Thousand Dollars) in
negotiation for your property, you may be entitled to a replacement housing
supplement of $17,055.00 (Seventeen Thousand Fifty -Five Dollars). This
supplement has been based on the asking price of the residential dwelling located
at 2301 Sycamore Trail, Round Rock, Texas. You do not have to purchase that
particular dwelling to qualify for your replacement housing supplement; however,
to claim this supplement, you must purchase and occupy a replacement home
costing $192,055.00 (One Hundred Ninety-Two Thousand Fifty -Five Dollars) or
more within one year as explained in the booklet. If you receive an amount other
than the $175,000.00 mentioned above for your property through negotiations or
condemnation, the amount of your housing supplement may have to be changed.
If you elect to purchase a replacement home costing less than $192,055.00, it may
be necessary to reduce the amount of the supplement. To avoid loss of benefits,
you are encouraged to contact your relocation agent before making a binding
commitment to purchase a replacement home.
3. If you choose to rent rather than purchase a replacement home, you may or may
not be entitled to a rental housing payment. You should notify your relocation

this agency will provide transportation to assist you to do so. If you wish to
examine other possible replacement homes of like price and functional qualities,
our relocation assistance personnel will be available to assist with each such visit
you would like to make during any reasonable duty hour.
5. If you elect to buy a replacement home and the mortgage interest rate exceeds the
one you are paying on the home you now occupy, you will be entitled to an
interest differential payment based on the lesser of the existing and new mortgage
balances and the shorter of the two mortgage terms. You may also be eligible to
receive reimbursement for actual incidental costs in closing, but not to include
prepaid expenses for financing the replacement dwelling.
6. Furthermore, you may be entitled to moving costs as explained in the booklet.
These costs, however, are limited to personal property and will not include any
costs for moving real property.
7. For you to be eligible for a supplemental housing payment, your replacement
home must conform to State requirements for decent, safe and sanitary housing.
To insure that your replacement home meets the required standards, we suggest
you have it inspected by your relocation agent before entering into a contract for
its purchase or rental. If this is not possible, we suggest that a provision be
included in the earnest money contract for the replacement property that the
contract is valid only if the property will pass a decent, safe and sanitary
inspection by your relocation agent.
8. Finally, if you are dissatisfied with a determination as to your eligibility for a
payment or the amount of any relocation payment, you may request a review of
your case.
We request that you thoroughly read and examine the booklet for additional information
and the requirements for payment eligibility. Assistance in preparing the necessary forms
and with the filing of your claims for any benefits to which you may be entitled, as well
as any additional information desired concerning our relocation assistance program, will
be made available to you from this office. If any such help is required, please contact

The variation in index numbers is largely due to the subject being considerably older than the comparables
used. The subject is also located in a rural area where land values are somewhat less than residential lots.
Displacees are in the process of acquiring a home in a subdivision, therefore not desiring to continue
residing in a rural setting. The availability of rural properties similar to the subject is very limited in this
area.
Four bedroom comparables were used due to the subject dwelling having a walk -in closet large enough to be
utilized as a bedroom. In addition, there are not three bedroom homes on the market that contain 1,968
square feet of living area.
A carve -out of the land is necessary due to the subject property being 1.49 acres. Typical residential Tots are
approximately 1/4 acre in the Round Rock area. Based on the appraisal value of $0.50 per sq.ft., 1/4 acre or
10,890 sq.ft. X .50 = $5,445. Value of improvements are $142,500. + $5,445. = $147,945., subjects
value.
Numerous properties for sale were considered; however, the two properties used were considered to be most
comparable to the subject. These homes would allow the displacees to continue with the same life style.
The supplemental payment(s) on page 1 have been determined by me and are to be used in connection with a federal -aid
highway project. The replacement housing used for these supplement computations are certified to he fair housing open to all
persons regardless of race, color, religion, age, sex, national origin or handicap and consistent with the requirements of Title
VIII of the Civil Rights Act of 1968. I have no direct nor indirect, present or contemplated interest in this transaction nor will
I derive any benefit from the supplemental payment.
