WHEREAS, the City of Round Rock has previously entered into an
agreement for engineering services ( "Agreement ") with Baker - Aicklen &
Associates, Inc. for the design of roadway improvements on CR 122 from
Forest Creek to Brushy Creek, and
WHEREAS, Baker - Aicklen & Associates, Inc. has submitted
Supplemental Agreement No. 1 for engineering services for a change in
the scope of services, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 1 with Baker - Aicklen & Associates, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 1 with Baker - Aicklen &
Associates, Inc. for engineering services for a change in the scope of
services.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

SUPPLEMENTAL AGREEMENT NO. 1
TO CONTRACT FOR ENGINEERING SERVICES
This Amendment to the Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Baker - Aicklen &
Associates, Inc., hereinafter called the "Engineer ".
WHEREAS, the City and Engineer executed a Contract for Engineering Services,
hereinafter called the "Contract ", on the 13 of May, 1999 to prepare right of way
documents, construction plans, specifications, and estimates for the interim wid-
ening of CR 122 from Forest Creek Drive to Brushy Creek; and the preparation of
a right of way schematic and a roadway design schematic for the future widening
of CR 122 from Forest Creek Drive to US 79 to a 4 -lane divided arterial, and
WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY
ENGINEER, describes those engineering services to be provided by the Engineer
as a part of the Contract, and
WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires termination of the
Contract on January 31, 2000, and
WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump
sum payable under this contract at $170,600 without modification of the contract,
and
WHEREAS, it has become necessary to amend the contract to provide for addi-
tional engineering services which include additional traffic control plans, and
WHEREAS, the Engineer has agreed to have the additional work performed for
$10,900 increasing the maximum lump sum fee for the contract to $181,500.
NOW THEREFORE, premises considered, the City and the Engineer agree that
said Contract is amended as follows:
ARTICLE 3, CONTRACT PERIOD, shall be extended until April 30, 2002,
ARTICLE 4, COMPENSATION, shall be amended by the changing the maxi-
mum lump sum amount payable under this contract to $181,500.
ATTACHMENT `B ", Services to be Provided by the Engineer shall be amended
as set forth in the attached ADDENDUM NO. 2 to ATTACHMENT B.
IN WITNESS WHEREOF, the City and the Engineer have executed Supple-
mental Agreement in duplicate.

3. A minimum of two (2) hours field party time charge will be made for show - up time and return to office,
resulting from inclement weather conditions, etc.
4. Field Party stand -by time will be charged for at the above -shown appropriate rates.
5. Rates apply to actual time GPS units are in use. All other time will be charged as appropriate normal field
party rates.
6. The firm's professional liability is limited to the total amount of compensation associated with a specific
project up to a maximum of $50,000.
