R- 01- 05- 10 -13B1 WHEREAS, the City of Round Rock is mandated by V.T.C.A., Tax Code §31.11 to refund, upon taxpayer application to the tax collector of its taxing unit and upon verification by the auditor of its taxing unit, any overpayment or erroneous payment of taxes; and WHEREAS, if such amount exceeds $500.00, then the governing body of the taxing unit must also determine that the payment was erroneous or excessive and must approve the refund, Now Therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the following named taxpayer, Round Rock Nissan, has made an overpayment or erroneous payment of 2000 taxes in the amount of $1,138.83; that such amount is in excess of $500.00; that such overpayment or erroneous payment has been verified by the Tax Collector; and that application for refund has been made to the Tax Collector by said taxpayer. The Council further finds and makes a determination that the payment was erroneous or excessive; and further approves such refund in the amount of $1,138.83. I received a call on March 13, 2001 from David at Round Rock Nissan indicating that he had paid us a check for $9514.32 in error back in November of 2000. Round Rock Nissan had already paid into their Special Inventory account during the year, then also sent in another check for $9514.32, paying the bill that he received in error for the county. The VIT bills were not to be maided out, but by an error on the system they went out. We had new people working in the office and the clerk did not notice that this was a special inventory account and she posted it to the county. The money went into the county account not the Special Inventory Account. This is why we did not know of this until David called us about his payment of$9514.32.. As I did my reports it threw the overage into the Round Rock City & School reports, since the county had been posted back in November. I am sending you copies of the reports I ran, it will show you the amount paid and the overage that was sent to you in error. I have to refund Round Rock Nissan the $9514.32 out of VIT, due to that Round Rock Nissan is holding David liable for the monies. In order of not having him to wait till we get the money back from you, I am cutting him a check from VIT, but I need to get this matter resolved as soon as you can. As soon as I receive your check for $9514.32 I can replace the money back into the VIT Account. I am sorry for the inconvience that this might have caused you, it was something that could not be detected right off., but we are working on a fix so that this does not happen in the future. Round Rock Nissan overpaid their tax in error. Williamson Co. has refunded the overpayment to the taxpayer and seeks reimbursement from the City.
