WHEREAS, the U.S. Department of Housing and Urban Development
( "HUD ") has grant funds available to cities through the Community
Development Block Grant Program, and
WHEREAS, the City Council wishes to make application for the
available grant funds for specific projects and activities identified
in the 2001 - 2002 Community Development Annual Action Plan that was
adopted by the City Council on October 1, 2001, Now Therefore

Grant Agreement
This Grant Agreement between the Department of Housing and Urban Development (HUD) and the above named Grantee is made
pursuant to the authority of Title I of the Housing and Community Development Act of 1974, as amended, (42 U.S.C. 5301 et seq).

This serves as official notification of approval of your Action Plan (AP) for Fiscal Year
2001. The grant for the program cited below is approved for the following amount:

The Consolidated Plan's One Year Action Plan (AP) begins on October 1, 2001 and
represents the forth year in a five -year Consolidated Plan and Strategy, which covers program
years 1998 through 2002. We appreciate the hard work of the City's Community Development
staff in producing this planning document for the City's future use of HUD program funds. The
two basic regulatory requirements for approval of the plan have been met. The Plan is not
substantially incomplete in addressing all regulatory requirements and is not inconsistent with
the purposes of the National Affordable Housing Act. Our conclusions for approval and the
comments cited in this review will be part of the national database within HUD's Grant
Management System (GMS).
The Action Plan overall has been formatted to present a concise but comprehensive
description on the use of the new program year funding. Narrative sections and charts have
been added to show other resources that will be utilized to meet the needs of the City's low
and moderate - income population groups. The citizen participation process, recommendations
and responses to comments were reported. The AP also presented a map showing citizens the
targeting of program funds to predominately low and moderate - income areas. We recommend
that future Action Plans present a map(s) showing the geographical impact and known location
of proposed projects.
24CFR 91.220 requires the Action Plan to show the priority designations, quantitative
goals and expected completions dates for each proposed activity. This will establish the basis
for performance evaluation when the City submits its end of the year CAPER (Consolidated
Annual Performance and Evaluation Report). The above information was not specifically
addressed in your listing of proposed projects. We request that the quantitative goals and
expected completion dates be included when setting up project data into the HUD IDIS system.

COMMUNITY DEVELOPMENT
It can be noted that approximately 89 percent of new program funding was allocated to the
City's high priorities designated in the 5 -Year Strategy submitted in 1998. Of the approximate
nine high priorities identified in your Consolidated Plan Strategy, the proposed activities
represents progress in three high priority categories (33 percent). The high priority
designations tell citizens the most about the before and after vision of the City in the use of
HUD Community and Planning Development resources. Since there is always a shortage of
funding to close the gap in unmet needs identified in your 5 -Year Strategy it is expected that
nearly all funding will be applied to high priority designated activities. An activity that you
expect to fund on a continual basis is by definition a high priority activity. In order to show the
greatest consistency between the Action Plan and The City's 5 -Year Strategy, consideration
should be given to amending the Priority Needs Table prior to or concurrent with submission of
the CAPER. The nine high priorities currently identified in your 5 -Year Strategy, Priority Needs
Table are cited below:

Your CAPER should report on cumulative progress in achieving high priority goals.
Proposed CDBG activities appear to meet regulatory eligibility requirements. However, a
review of public service activities could not be undertaken since actual funding will occur after a
request for proposal process is completed. Please keep in mind that a narrative must be
submitted to this office if any funded public service is expected to meet the "no record keeping"
option under the national objective of low and moderate income limited clientele (see 24 CFR
570.208(a)(2) (i)(C)).
Enclosed are Grant Agreements and Funding Approvals for each program, which
constitute the contracts between the Department of Housing and Urban Development and the
City of Austin. Please execute and return two copies of the form to this office. Failure to return
the executed funding form within 60 days may be deemed to constitute rejection of the grant
and cause for HUD to determine that funds are available for reallocation to other grantees.
Should there be a need to establish or change the depository account where the grant
funds are being wired to, a Direct Deposit sign -up form (SF- 1199A) must be completed by both
the City and involved financial institution and mailed to our Field Office.
We want to remind the City that certain activities are subject to the provisions of 24 CFR
Part 58 (Environmental Review Procedures for the CDBG Program). Funds for such activities
may not be obligated or expended unless there is a written release of funds notification from
our Field Office. To initiate this process for these activities, the City must submit to our office
an executed HUD form 7015.15 - Request for Release of Funds and Certification.

If your Action Plan proposed activities that include funds for the planning or construction
of water or sewer facilities, such activities are subject to review under Executive Order 12372,
Intergovernmental Review of Federal programs, and HUD's implementing regulations at 24 CFR
Part 52. A written release of funds for such activities is required. Note that such a special
condition applies to water or sewer activities not previously submitted for E.O. 12372 reviews
that you may add through an amendment or other revision to your Consolidated Plan.
We thank you for the submission of this Action Plan. During the next year, we look
forward to continuing our successful partnership with the City.
