RESOLUTION NO. R- 01- 12- 20 -10D6 WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering Services with Earth Tech Transportation Services, Inc. for the preparation of schematics, environmental documents, right -of -way documents, plans, specifications, and estimates for the realignment of South Mays Street, Dell Way, Hester's Crossing, and the extension of Gattis School Road from South Mays Street to the IH 35 East Frontage Road, and WHEREAS, Earth Tech Transportation Services, Inc. has submitted Supplemental Agreement No. 2 to Contract for Engineering Services for a change in the scope of services, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 2 to Contract for Engineering Services with Earth Tech Transportation Services, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 2 to Contract for Engineering Services with Earth Tech Transportation Services, Inc. for a change in the scope of services, a copy of said amendment being attached hereto as Exhibit "A" and incorporated herein for all purposes. :: O➢ MA\ WORL00%\ 0 . \W00 % \RESOLUTI \R1122006.WPD /[m The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. MARTINEZ, City Secretar 2 City of Round Rock, Texas STATE OF TEXAS THE COUNTY OF WILLIAMSON SUPPLEMENTAL AGREEMENT NO. 2 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Earth Tech Transportation Services, Inc., hereinafter called the "Engineer ". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 24 day of November, 1998 and subsequent Supplemental Agreement 1 concerning the realignment of South Mays Street, Dell Way, Hester's Crossing, and the extension of Gattis School Road from South Mays Street to the IH 35 Frontage Road, and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, as amended in Supplemental Agreement 1 requires the termination of the Contract on December 31, 2001 unless the Contract is extended, and WHEREAS, ARTICLE 4, COMPENSATION, as amended in Supplemental Agreement 1 establishes a time and material basis of payment not to exceed $294,000.00 without modification of the contract, and WHEREAS, it has become necessary to amend the contract to provide for a change in the scope of services to include the design of the wall for Dell Way at Mays Street, and WHEREAS, the increase in the scope of work will require the Contract Period to be extended until June 28, 2002, and WHEREAS, the Engineer has agreed to perform the additional work for $13,484.44 increasing the fee for the contract to $307,484.44. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD shall amended by extending the termination date of the Contract to be the close of business on June 28, 2002. EXHIBIT "A" ARTICLE 4, COMPENSATION, shall be amended by the changing amount payable under this contract to $307,484.44. ATTACHMENT `B ", Services to be Provided by the Engineer shall be amended as set forth in the attached ADDENDUM NO. 2 to ATTACHMENT B. The Engineer will provide the following services: ADDENDUM NO. 2 TO ATTACHMENT B SERVICES TO BE PROVIDED BY THE ENGINEER WALL FOR DELL WAY @ MAYS STREET Tree Well Design • Provide layouts with station and offsets (4 trees) • Provide tree well detail sheet • Revise roadway detail sheet Project Management • Manage Schedule • Prepare Invoices • Participate in meetings • QA/QC Subsurface Exploration (PSI Scope of Services) The subsurface exploration will include the following services: • Sampling and testing of the subsurface materials and observations of the groundwater conditions along the proposed wall alignment, to depths that would significantly affect or be affected by the foundations. • Identification of the physical and engineering characteristics of subsurface materials encountered during the sampling and testing. • Recommendations of the type or types of foundations, which would be suitable for the proposed wall, and provision of data for use in foundation design and construction. It is proposed to explore the subsurface materials and groundwater conditions at the site by drilling test borings using truck mounted drilling equipment. PSI proposes to drill five (5) test borings equally spaced along the proposed wall alignment to depths of approximately 15 feet below existing site grades. Rock that is encountered in the borings will be cored to define its properties. The ground surface elevations at the test boring locations will be estimated from topographic plans provided to PSI by the client. The subsurface exploration will include laboratory testing of the samples obtained to evaluate the classification, strength, plasticity, and other characteristics of the subsurface materials involved. The results of the field exploration and laboratory tests will be used in the engineering analysis and in the formulation of the recommendations. The results of the subsurface exploration, including the recommendations and the data on which they are based, will be presented in a written report prepared by a professional engineer. This contract will expire on December 31, 2001. Approval of Supplemental Agreement No. 2 will amend the contract to: (1) provide for a change in the scope of services to include a design of the wall for Dell Way at Mays Street at a cost of an additional $13,484.44 and (2) extend the termination of the contract to June 28, 2002. Staff recommends approval.
