2. Consultant's poll will sample 400 residents of the City of Round Rock.

This letter will serve to set forth the terms and conditions under which Jeff
Montgomery and Associates, Inc. ( "Consultant ") would agree to furnish certain services the
City of Round Rock ( "City").
1. City desires to retain the Consultant to write, perform, and analyze a statistical
phone poll in the City of Round Rock.
3. The Consultant will draft an initial script for said poll; oversee paid phoners in
Consultant's office; and provide City with two (2) analyses (two sets of crosstabs
with reports) plus ten summary handout reports. Jeff Montgomery shall also be
available for presentation to the City Council and /or City staff as requested to
review the results of the poll.
4. The City agrees to pay Consultant a fee of Eighteen Thousand Dollars
($18,000.00) in exchange for Consultant's services described above. Said fee shall
be payable as follows:
$5,000.00 to be paid on or before the beginning of phoning for the project
$13,000.00 to be paid upon delivery of analyses
5. No information about the polls will be released by Consultant except as requested
by the City.
6. Any sums due hereunder that City is not required to prepay shall be due when
scheduled.
7. Either party may terminate this agreement upon thirty (30) days' written notice to
the other party, subject to the following conditions:
a. Any amount already paid or due to have been paid to the Consultant pursuant
to section 4 need not be returned. Any amount due shall be paid immediately
by City.
b. All vendor bills and expenses incurred to date of termination shall be paid
immediately by City.
8. This agreement supersedes any and all other agreements, either oral or written
between the parties hereto with respect to the subject matter hereof, and no other
agreement, statements or promises relating to the subject matter of this agreement
which is not contained herein shall be valid or binding.
If the foregoing correctly reflects your understanding of our mutual intentions, please sign
and date and retum a copy of this letter to the undersigned.

WHEREAS, the City of Round Rock desires to retain professional
consulting services for a statistical phone survey, and
WHEREAS, Jeff Montgomery & Associates, Inc. has submitted a
letter of agreement to provide said services, and
WHEREAS, the City Council desires to enter into said letter of
agreement with Jeff Montgomery & Associates, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a letter of agreement with Jeff Montgomery &
Associates, Inc., for professional consulting services for a statistical
phone survey, a copy of said letter of agreement being attached hereto
as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.
