R 02 04 25 - 11D2 WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering Services ( "Contract ") with Baker - Aicklen & Associates, Inc. for the design of roadway improvements on CR 122 from Forest Creek Drive to Brushy Creek, and WHEREAS, Baker - Aicklen & Associates, Inc. has submitted Supplemental Agreement No. 2 to Contract for Engineering Services for a change in the scope of services, and WHEREAS, the City Council desires to approve said Supplemental Agreement No. 2 with Baker - Aicklen & Associates, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 2 to Contract with Baker - Aicklen & Associates, Inc. for a change in the scope of services, a copy of said Supplemental Agreement No. 2 being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. STL KA, JR.'Mayor City of Round Rock, Texas STATE OF TEXAS § THE COUNTY OF WILLIAMSON § SUPPLEMENTAL AGREEMENT NO. 2 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Baker - Aicklen & Associates, Inc., here- inafter called the "Engineer ". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 13 of May, 1999 to provide right of way documents, construction plans, specifications, and estimates for the interim widening of CR 122 from Forest Creek Drive to Brushy Creek; and the preparation of a right of way schematic and a roadway design sche- matic for the future widening of CR 122 from Forest Creek Drive to US 79 to a 4 lane divided arterial, and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires the termination of the Contract on April 30` 2002 unless the Contract is extended, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $182,900.00 without modification of the contract, and WHEREAS, it has become necessary to amend the contract to provide for the placement of lathes along the new right of way of six parcels, and WHEREAS, the Engineer has agreed to have the additional work performed for $900.00 in- creasing the lump sum fee for the contract to $183,800.00. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD, shall be amended to extend the contract period to October 31 2003, and ARTICLE 4, COMPENSATION, shall be amended by the changing the lump sum amount pay- able under this contract as $183,800.00. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 2 with Baker- Aicklen & Associates, Inc., for the design of roadway improvements on CR 122 from Forest Creek to Brushy Creek. This is for the placement of right -of -way lathes for six additional properties in the amount of $900. This will bring the total cost of the contract to $183,800. History: The original contract was approved on May 13, 1999 by Resolution No. R- 99-05- 13B 15 for preparation of right of way documents, construction plans, specifications, and estimates for the interim widening of CR 122 from Forest Creek Drive to Brushy Creek; and the preparation of a right of way schematic and a roadway design schematic for the future widening of CR 122 from Forest Creek Drive to US 79 to a 4 -lane divided arterial. Supplemental Agreement No. 1, Resolution 01- 04- 26 -14E6, modified the Scope of Work to include the preparation of a traffic control plan. Resolution 01- 09- 13 -15F5 approved an additional service agreement for the placement of right of way lathes every 50 feet on additional takings on CR 122; this work was at a cost of $1,400 and brought contract total to $182,900. Approval of Supplemental Agreement No. 2 would allow for the placement of right of way lathes for six additional properties in the amount of $900; this will bring the total cost of the contract to $183,800. Impact/Benefit: This project will improve safety and mobility for this road, and reduce maintenance activities and costs associated with the existing pavement.
