R- 02- 06- 13 -14G6 WHEREAS, the City of Round Rock ( "City ") desires to expand the land area for its water treatment facilities, and WHEREAS, Texas Crushed Stone ( "TCS ") has an aircraft landing and take off runway which points across the area where the water treatment plant is located, and WHEREAS, both the City and TCS desire the approaches and take offs from the runway to be as safe as they can make them, and WHEREAS, the Council wishes to enter into an Avigation Easement with TCS, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an Avigation Easement with Texas Crushed Stone, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. Now therefore the City of Round Rock, a home rule city in the State of Texas, of Williamson County, Texas, ( "Grantor") owner of the land in the Ephriam Evans League, Williamson which is described in Exhibit "A" which is attached hereto and made a part hereof as if set out in full herein, in consideration Ten and no /100 Dollars ($10.00) and other valuable consideration, receipt of which is hereby acknowledged, does hereby grant, bargain, sell and convey to Texas Crushed Stone Company of P.O. Box 1000, Georgetown, Williamson County, Texas 78627, ( "Grantee ") the following: An avigation easement for the airplanes taking off and landing on the aircraft landing strip runway located on Texas Crushed Stone Company land restricting any and all structures from extending or being above 842 feet above mean sea level. There is a currently existing tower which is believed to be 943.3 feet above mean sea level and it is agreed, provided and stipulated that it will be permitted to continue to exist and that it may not be extended above its currently existing height. It is further agreed, provided and stipulated that any and all other towers to be constructed or erected upon the property described in Exhibit "A" shall be constructed or erected in that area shown on Exhibit "B" which is attached hereto and made a part hereof as if set out in full herein. Towers erected in the area permitted on Exhibit "B" may be up to 1,000 feet above mean sea level. This easement is for the benefit of and appurtenant to the land or any portion of the land upon which the aircraft landing strip runway is located.
