R- 02- 06- 27 -9B3 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with Rodriguez Transportation Group, Inc. to complete Phase I and provide inspection services for A.W. Grimes Boulevard, and to complete the design of Phase II for A.W. Grimes Boulevard, and WHEREAS, Rodriguez Transportation Group, Inc. has submitted Supplemental Agreement No. 1 to the Contract to extend the contract date and to change its name to Rodriguez Transportation Group, Inc., and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 to the Contract with Rodriguez Transportation Group, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Contract with Rodriguez Transportation Group, Inc., a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. MARTINEZ, City Secff 2 N E MAXWELL, Mayo City of Round Rock, Texas STATE OF TEXAS THE COUNTY OF WILLIAMSON § SUPPLEMENTAL AGREEMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Rodriguez & Huggins, Inc., hereinafter called the "Engineer ". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 14 of June, 2001 to complete Phase I and provide inspection services for A.W. Grimes Boulevard, and to complete the de- sign of Phase II for A.W. Grimes Boulevard and Gattis School Road, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires termination of the Contract on June 28, 2002, and WHEREAS, Rodriguez & Huggins, Inc., filed an Articles of Amendment with the Texas Secretary of State's office on July 30, 2001 to legally change the firm's name to Rodriguez Transportation Group, Inc., a copy of which is attached hereto; and, WHEREAS, effective the 30th day of July, 2001, the Engineer is no longer con- ducting business under the name of Rodriguez & Huggins, Inc., and has subse- quently been renamed Rodriguez Transportation Group, Inc., with the mailing ad- dress of 11211 Taylor Draper Lane, Suite 100, Austin, Texas, 78759, with no sig- nificant changes in Key personnel or resources; and, WHEREAS, it is in the City's best interest to extend the term of the Contract until December 31, 2002, and NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: The Engineer is renamed from Rodriguez & Huggins, Inc., to Rodriguez Transpor- tation Group, Inc.; and who by signing this Supplemental Agreement, accepts all EXHIBIT 1 °Au the terms and conditions of the Contract, and further agrees to complete all ser- vices required of the Engineer by the Contract. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 1 to the Contract for Engineering Services with Rodriguez Transportation Group, Inc. to complete Phase I and provide inspection services for A.W. Grimes Boulevard, and to complete the design of Phase II for A. W. Grimes Boulevard Resource: Jim Nuse, Chief of Operations /Assistant City Manager Tom Word, Director of Transportation Services History: The original contract was approved by Council by resolution no. R- 99- 05- 13 -13B12 to establish the alignment of Arterial B from US 79 to South of Louis Henna Boulevard, prepare a schematic of Arterial B, monument the alignment, and prepare the right of way documents for critical parcels. Supplemental Agreement No. 1 was approved on November 9, 1999 for additional surveying and engineering services related to preparation of right of way documents, construction plans, specifications and estimates for the construction of Arterial B from Louis Henna Boulevard to south of Louis Henna Boulevard along County Road 170. Supplemental Agreement No. 2 was approved on January 13, 2000 to provide for construction cost estimates for SH 45 from Arterial B to County Road 172 and to establish the center line of SH 45 from west of Greenlawn to Doublecreek Drive and construction plans for Arterial B from Louis Henna Boulevard to US 79. Supplemental Agreement No. 3 was approved on September 14, 2000 to prepare Arterial B project plan set for inclusion in Texas Turnpike Authority. The contract approved June 14, 2001 provided for additional work on A.W. Grimes Boulevard (Arterial B) to include (I) construction services, and (2) Section 404 Permit Support, Endangered Species Review and Habitat Assessment, and Archeological Reconnaissance and Agency Coordination by Hicks & Company, Inc., (3) field notes, sketches, easements for Dell Tract, East Rock Cove, Miller Tract, and Hickerson Tract by Surveying and Mapping, Inc., (4) bridge and retaining wall design and details Dry Creek Tributary No. 1 by Fields Engineering, Inc, (5) geotechnical engineering services by Raba - Kistner - Brytest Consultants, Inc., (6) creek crossing surveys and data reports by Espey Consultants, Inc., and (7) prepare preliminary design on widening of Gattis School Road by Huggins /Seiler & Associates, LLP. The cost of that contract was $915,993.90. This Supplemental Agreement No. 1 will extend the contract time until December 31, 2002. Funding: Cost: $0 Source of funds: Transportation System Development Corporation Outside Resources: Rodriquez Transportation Group Impact/Benefit: This project will provide for a new Brushy Creek Road Crossing and will provide much needed north/south access east of downtown Round Rock. This roadway will greatly enhance mobility and safety.
