R- 02- 07- 25 -14A1 WHEREAS, the City of Round Rock has duly advertised for bids for the purchase of fire equipment to be carried on two new fire engines, and WHEREAS, the City Council wishes to accept the bids of the suppliers for the fire equipment which are the lowest responsible bids as to specific types of equipment, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the bid Dooley Tackaberry Fire & Rescue Equipment is hereby accepted as the lowest responsible bid for the equipment listed on Exhibit "A" and the City Manager is hereby authorized and directed to issue a purchase order in the amount of $14,182.65 for said equipment, and That the bid Fire Supply, Inc. is hereby accepted as the lowest responsible bid for the equipment listed on Exhibit "B" and the City Manager is hereby authorized and directed to issue a purchase order in the amount of $1,467.83 for said equipment, and That the bid Metro Fire Apparatus Specialists, Inc. is hereby accepted as the lowest responsible bid for the equipment listed on Exhibit "C" and the City Manager is hereby authorized and directed to issue a purchase order in the amount of $2,961.00 for said equipment, and That the bid Wilson Fire Apparatus & Equipment is hereby accepted as the lowest responsible bid for the equipment listed on Exhibit "D" \ WORL00 X \0: \WDOX \RESOLIJTI \R20725A1. and the City Manager is hereby authorized and directed to issue a purchase order in the amount of $8,686.00 for said equipment, and That the bid Casco Industries, Inc. is hereby accepted as the lowest responsible bid for the equipment listed on Exhibit "E" and the City Manager is hereby authorized and directed to issue a purchase order in the amount of $3,658.00 for said equipment. Resource: Lynn Bizzell, Fire Chief History: Staff recommends the issuance of these purchase orders to fully equip the two new engines that have been ordered and will be delivered in August — September 2002. The equipment is compatible and will be used to keep all engines as uniform as possible. All items have been tested or are currently in use by our department. The items recommended for purchase are low bid and/or meet specifications written by the equipment team. On Tuesday, July 9, 2002 we received 7 bids for fire equipment to be placed on the two new engines. The varied equipment was awarded to 5 of the 7 vendors winning different parts of the equipment list. Staff would like to propose awarding the fire equipment bid to the noted 5 vendors. Cain Director Hilgers & Watkins, P.C. Randy C. Cain represents clients before the Texas Legislature in the areas of municipal affairs, public safety, health care law, transportation and other matters. He is also engaged in the practice of administrative law, and offers legal and consulting services for election law and state ethics matters. Immediately before returning to Hilgers & Watkins in December 1994, Mr. Cain served as general counsel to the Texas Secretary of State. As general counsel he was chief legal advisor to the Secretary on all matters within agency jurisdiction, including election law, agency administration, ethics, and statutory filings. In 1993 -94, Mr. Cain served as Deputy to the Assistant Secretary for Legislative Affairs at the U.S. Department of the Treasury. As a member of Secretary Lloyd Bentsen's legislative staff at the Treasury Department, he worked on the passage of NAFTA, budget reconciliation and banking regulatory consolidation, among other issues. Mr. Cain met with congressional staff on treasury legislative initiatives, set up meetings with members of Congress, and prepared legislative briefings for the Secretary of the Treasury. Prior to his work at the Treasury, Mr. Cain was Legislative Director in Washington, D.C. for Senator Lloyd Bentsen during 1992 -93. He directed a legislative staff of twelve persons. He supervised preparation of legislation, floor statements, and the answering of constituent mail. He assisted the council and manager in formulating the city's objectives for the 1991 and 1993 Texas Legislative Sessions. He reviewed thousands of filed bills which might have affected municipal government and kept the council and manager informed in weekly meetings. In the 1991 session, the Texas Legislature passed into law nine bills that were Dallas city priorities. Additionally, he monitored interim committees and participated in Sunset Commission review proceedings. Before his work in Dallas, Mr. Cain practiced law for three years with Hilgers & Watkins. The majority of his practice consisted of civil trial work, including most areas of commercial litigation and consumer law. Susan C. Rocha Partner Denton, Navarro & Bernal, P.C. Ms. Susan Rocha has been a partner with Denton, Navarro & Bernal since 1994. Her practice consists of lobby representation, a city attomey practice for smaller municipalities, and representing public entities in litigation. Ms. Rocha served as Senior Intergovernmental Relations Officer for the U.S. Department of Housing and Urban Development. In 1992, at the request of Texas Attorney General Dan Morales, Ms. Rocha created the Office of Municipal Affairs for the Attomey General's Office. This office was charged with representing the interests of Texas cities in the Attorney General's office. She also served as First Assistant General Counsel at the Texas Municipal League for four and one -half years. Ms. Rocha was also an Assistant City Attorney for the City of San Antonio. Ms. Rocha brings vast, statewide experience in issues facing local governments. She has consulted with hundreds of elected officials across the state on the legal problems that local governments face on a day -to -day basis. She is a frequent speaker at State Bar seminars on local government issues, and she regularly speaks at Texas Municipal League Conferences and Workshops. Ms. Rocha has taught a course on Municipal Corporations at St. Mary's University School of Law. Ms. Rocha has practiced in the area of local government representation for over sixteen years. Susan graduated from the University of Dayton, Ohio, in 1973 and received her law degree from the University of Texas School of Law in 1982. She was a junior high and high school teacher before entering law school. RECAP OF PREVIOUS SESSION WORK FOR MUNICIPALITIES 77 Legislative Session (2001) During the 77 Legislative Session, Susan Rocha and Randy Cain represented the City of Lubbock as a lobby team. Some of the Legislation they helped the City of Lubbock navigate through this process were bills that shifted the liability for law enforcement activities to the requesting municipality or county when responding to a request by that governmental entity for assistance, and clarifying the powers, responsibilities and the membership composition of the Lubbock Reese Redevelopment Authority (LRRA). They also assisted with two economic development bills. One allowed for a tax abatement to the lessee of properties and included tangible property in the abatement. Also, the City of Lubbock requested legislation that would allow for the municipality to recapture some of the property tax loss in the tax abatement when a business fails to provide the jobs and other business incentives that the company agreed to develop in order to receive a tax abatement. The City of Lubbock also initiated a bill to clarify the authority of a governmental body to call for an election. For San Antonio, Susan worked on proposed legislation dealing with the expansion of the single member districts of the City Council by ordinance, private activity bonds for the affordable housing development, a records retention fee on birth and death records to assist the vital statistics registrar, and the impact fee legislation. Last legislative session, amendments to the impact fee statute, pushed by the developers and homebuilders, passed both the house and the senate and landed on the governor's desk. The bill was detrimental to cities and would have essentially eliminated the impact fee currently allowed under state law. At the request of the Texas Municipal League and several cities, the governor vetoed the bill. Knowing that this issue would resurface this session, the Texas Municipal League created a legislative subcommittee dealing with impact fees. A bill was drafted and negotiated with the developers, homebuilders, and city officials. A compromise between parties was reached and the bill passed after adjustments were made for the City of San Antonio and Austin. Both of these cities supply water outside their city limits that triggers an impact fee. Although the impact fee that cities charge will be lessened, several clarifications C: \WINDOWS \Temporary Internet Files \OLKC25l\Proposal.doc were made in the statute. Additionally the bill allows the cities to revisit their current calculations of impact fees. The last few weeks of this legislative session were devoted to stopping land use regulations that would have had an adverse affect on cities. These bills were supported by the Board of Realtors, the Texas Association of Builders, and the Association of Urban Counties. In various forms, these bills would have restricted the city's ability to regulate development. If these bills had passed, our cities would effectively have lost land use regulation in the ETJ, which would have affected our water quality, water conservation ordinances, and smart growth policies. HB 1445 requires an agreement with the county on land use regulations in the ETJ. The most harmful version of the bill was negotiated to allow for an agreement between the two. Some cities have had trouble reaching a consensus with their counties, which the sponsor of the bill intends to monitor. Another bill would have required the city to pay a property owner for any down zoning of their property that results in a 25% loss in value. The bill would have required that the city go through a condemnation proceeding and pay the property owner. Other bills would have allowed for manufactured housing to be placed in any residential neighborhood. Susan and Randy also followed the Sunset of the TNRCC bill with particular regards to increasing the regulation of "shame recycling centers" that really are, in fact, landfills. They also worked closely with the Texas Municipal League regarding any additional charges to utilities to fund water projects by the state and Susan monitored other legislative programs for the City of San Antonio including the Cibolo Canyon Conservation District. For the City of Austin, Susan monitored bills that adversely affected a city's land use regulations, particularly the bills that would have exempted religious organizations from either planning or zoning. Other bills would have prohibited a city from imposing a moratorium. This bill was also amended to allow for moratoriums with certain restrictions. In coordination with the City of San Antonio, Susan has also assisted the City of Austin in obtaining witnesses for land use legislation and assisting in defeating legislation that would have reopened the old Austin airport and would have allowed for public utilities to receive a variance on an impervious cover regulation if the city did not decide within 30 days. Like the City of San Antonio, the City of Lubbock and Austin own their own electric and water system. During the session, Susan also represented the Building Officials Association of Texas and Randy represented the Fire Chief's Association of Texas. For the Building Officials Association (BOAT), Susan was able to introduce legislation that added the International Plumbing Code and the International Mechanical Code to state law. These codes are the result of the merger of three different code producers who previously produced separate and distinct codes. State law needed to be amended in order to allow municipalities and other local governments to select the International Code series for their entities. In C: \W INDOWS \Temporary Internet Files \OLKC251\Proposaldoc representing the Fire Chiefs, the issues of collective bargaining and meet and confer were at the forefront. Additionally, several bills were introduced that would have required fire departments to have minimum manning standards for fire apparatus. Randy monitored this legislation on behalf of the Fire Chief's and assisted in providing testimony for these bills from Fire Chiefs. 76 Legislative Session (1999) During the 1999 Legislative Session, Susan Rocha and Randy Cain together represented the City of Lubbock and the City of El Paso. Separately and respectively, Susan and Randy represented the City of San Antonio and the City of Dallas. In 1999, Texas cities faced one of the toughest legislative sessions in history. Bills were introduced to either restrict or eliminate a city's authority to annex property, impose an impact fee for new development, charge a franchise fee for use of a public right -of -way by telephone companies, create a state religious freedom restoration act, allow for the location of mobile homes in residential zones, electric deregulation, and to regulate development in its extraterritorial jurisdiction. Additionally, some bills would have imposed additional state fees for municipal courts. Because of these issues, it was paramount during the 1999 Legislative Session that the largest cities in Texas, including Lubbock, El Paso, San Antonio, and Dallas join to form a unified front to face this assault on Texas cities. Although several restrictions were placed on Texas cities as a result of this session, most of the bills passed had the input and suggestions that were requested by our cities. Lubbock and El Paso were instrumental in placing some exceptions in the Annexation Bill as a result of the lobbying efforts of both Randy and Susan. Over 1,000 bills were tracked and monitored by Susan with biweekly reports submitted to the cities of Lubbock, El Paso and San Antonio. On the offense, the City of El Paso had approximately seven legislative priorities and the City of Lubbock had approximately six. Randy and Susan were able to assist the City of El Paso in insuring that El Paso's unique municipal court system (it is one of only two municipal courts in the state that elect their municipal court judges, and they have a Municipal Court of Appeals) was not affected during the statewide consolidation of municipal court statutes. Other legislation passed for the benefit of El Paso included an amendment to the Pension Fund Statute that would allow the City to merge its EMS and Fire Departments, a bill that will allow for cities to create an intermodal transportation hub, the creation of a Border Health Institute, and a correction regarding the qualification of their municipal court jurors. A design/build bill was also introduced that would have allowed cities to use this turnkey process in capital construction. Although not successful during the legislative term, this issue has been the subject of an interim charge of the Senate Intergovernmental Relations Committee. For the City of Lubbock, Randy and Susan were able to shepherd passage of legislation that would allow the City to regulate the modification of playa lakes in their extraterritorial jurisdiction, to develop property around a city-owned recreation area, and C: \WINDOWS \Temporary Internet Files \OLKC25I \Proposal. doe C: \WINDOWS \Temporary Internet Files \OLKC251\Proposeldoc to improve the Lubbock/Reese Air Force Base Redevelopment Authority, naming Lubbock the "Music Crossroads of Texas," and legislation allowing for the dissolution of an economic development corporation. San Antonio sought introduction and passed legislation that dealt with a property conveyance to the Greater Kelly Development Corporation (GKDC) and created a separate statute for the GKDC. San Antonio also introduced legislation that would give cities more authority in the regulation and eradication of graffiti, a procedure to allow for neighborhood associations to assist in code compliance, provide for a scrap tire program, and cost recovery for open records and records preservation. Several crime bills were also introduced by San Antonio that dealt with child endangerment, crimes against the elderly, increase in district courts, heightened penalty for assault of a public servant (teachers), truth in sentencing, and special enhancements for certain victimized property owners. The City also monitored and supported city/county consolidation, and actively supported the legislation that allowed San Antonio, with state support, to submit a proposal for the Pan Am games. Randy also represented the North Texas Tollway Authority during the 76 Session. The Authority sought passage of legislation that would allow it to enter into agreements with the Texas Transportation Commission and to alter speed limits on a turnpike project. His efforts on behalf of the Texas Fire Chiefs Association, a TML affiliate, helped bring about the creation of the new TDH Advisory Council on EMS. Additionally, Susan represented the Building Officials Association of Texas in monitoring legislation that would have affected a local government's ability to select building, mechanical, plumbing, and fire codes. Attempts were made to limit a municipality's authority to select the code of its choice. The Building Officials introduced legislation to ensure that cities had the authority to select whichever code they believe is best for their locality. 75th Legislative Session (1997) During the 1997 Legislative Session, Susan served as a technical consultant for the City of San Antonio's State Legislative program. Susan was responsible for tracking all legislation that affected the City of San Antonio, the City Water Board and the City Public Service. Her participation in the process was on a technical review basis with emphasis on notification of detrimental legislation that affected all cities and particularly those that were directed at the City of San Antonio. One of her responsibilities and duties was to draft alternative legislation or to make suggestions for necessary changes to legislation that would neutralize the detrimental effect to the City of San Antonio. Although Susan was not hired as a lobbyist for the City of San Antonio, she worked closely with the lobby consultants and the City staff regarding the progress of all City legislation. During the 1997 legislative session, Susan and Randy were lobby consultants for the City of Lubbock. This was Lubbock's first venture into the legislative process with hired outside consultants. Susan and Randy assisted the City of Lubbock in the development of its legislative program; in seeking sponsors for introduction of specific City of Lubbock legislation; coordinating the testimony of City officials on bills that affected not only the City of Lubbock but all Texas cities, particularly annexation; and lobbied to defeat bills that were detrimental to the City of Lubbock and other Texas cities. The City of Lubbock worked closely with the Texas Municipal League in the coordination of witnesses to testify on annexation issues. During this 1997 Legislative Session, Susan and Randy assisted in the passage of several bills that were beneficial to the City of Lubbock and to Texas cities in general. The City sponsored legislation that allowed the City of Lubbock to use its own bond rating and bond issuance in a multi - governmental project with the Canadian River Authority that saved the City of Lubbock $2.4 million in interest rates as bonds were repaid. The City of Lubbock requested that a bill be introduced to create the Lubbock/Reese Redevelopment Authority that provided for a separate governmental entity to deal with the closure of Reese Air Force Base. Under the bill, the city participates in the selection of the board of directors along with several other governmental entities, but the statute is specific that it is a separate body politic apart from the city. The City of Lubbock was interested in creating a separate and distinct entity should any liability result because of the base closure. A joint bill was also passed that was requested by the City of Lubbock and Texas Tech University regarding the auditorium/coliseum. Additionally, a bill was passed to make clear that the City could use the number of water hookups in the determination of its drainage fee, and a bill was passed to allow for the extension of the regulations and ordinances of a joint airport zoning board after the military base closed. The City of Lubbock, like the City of San Antonio owns it own electrical and water systems so the electric deregulation fight and SBl was closely monitored and reviewed. Additionally, our City of Lubbock witnesses whom we prepared and assisted in the drafting of testimony were instrumental in influencing the Senate and House committees regarding their proposed bills on annexation. Susan also assisted the City of Austin on an as- needed basis particularly in the defeat of legislation that dealt with certain MUD's on the northern end of the City. Her main function was to work with members of the calendars committee regarding City of Austin legislation particularly in the waning months of the Legislative Session. Tracking of Legislation and Wrap - up Mr. Cain and Ms. Rocha during the past three legislative sessions have developed a tracking system that summarizes important legislation with a brief description of its affect, the department it affects, and a suggested position. They will again provide and assist in the development of legislation, as well as providing a written wrap -up of the Legislative Session's high- points regarding areas of interest. Over 600 bills in 1995, 1,200 in 1997 and 1,000 in 1999 were monitored and reported in the tracking file.
