WHEREAS, the City of Round Rock has previously entered into a
Contract for Engineering Services with Chiang, Patel & Yerby, Inc. for
the design of box culverts under R.M. 620 at the Round Rock Hospital,
and
WHEREAS, Chiang, Patel & Yerby, Inc. has submitted Supplemental
Agreement No. 2 to the Contract for Engineering Services to extend the
contract date, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 2 with Chiang, Patel & Yerby, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 2 to Contract for
Engineering Services with Chiang, Patel & Yerby, Inc. to extend the
contract date, a copy of said amendment being attached hereto as
Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

SUPPLEMENTAL AGREEMENT NO. 2
TO CONTRACT FOR ENGINEERING SERVICES
This Amendment to the Contract for Engineering Services is made by and between the City of
Round Rock, Texas, hereinafter called the "City" and Chiang, Patel, & Yerby, Inc., hereinafter
called the "Engineer ".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract ", on the 26`" day of October, 2000, to provide professional engineering and
technical services for the design of box culverts under R.M. 620 at the Round Rock Hospital, and
WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires the termination of the Contract on
the 28 day of June, 2002 unless the Contract is extended, and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
ARTICLE 3, CONTRACT PERIOD, shall be amended to extend the contract period to June 30
2003, and
IN WITNESS WHEREOF, the City and the Engineer have executed Supplemental Agreement
in duplicate.

Supplemental Agreement No. 2 to the Contract for Engineering

culverts under R.M. 620 at the Round Rock Hospital.

History: The City Council approved an engineering contract as Resolution No. R- 00 -10-
26-13G3 at its regular council meeting on October 26, 2000 to provide
professional engineering and technical services for the design of box culverts
under R.M. 620 at the Round Rock Hospital. A Supplemental Agreement No. 1
to this contract was approved on December 20 * , 2001 which extended the
contract until June 28, 2002. Authorizing the ap of Supplemental
Agreement No. 2 will extend the contract until June 30` , 2003 and this will allow
more time for coordination with outside agencies such as the Texas Department of
Transportation.

Cost: $0
Source of funds: N/A
Outside Resources: Chiang, Patel, & Yerby, Inc.
Impact/Benefit: A time extension on this contract will allow the engineer to complete the
city's scope of work under the original contract.

The Round Rock City Council approved the following two Resolutions at their regularly
scheduled meeting on July 25, 2002:
• Resolution No. R- 02- 07- 25 -14F1 which approves Supplemental Agreement No. 2 for
the extension of the contract date for the realignment and reconstruction of CR 113
from FM 1460 to the abandoned MKT Railroad right -of -way in Williamson County.
• Resolution No. R- 02- 07- 25 -14F2 which approves Supplemental Agreement No. 2 for
the extension of the contract date for the design of box culverts under R.M. 620 at the
Round Rock Hospital.
