Dated July 5, 2002 GENERAL This constitutes an Amendment to the Contract for Engineering Services — 1998/1999 Water System Improvements Project for PROFESSIONAL SERVICES between the City of Round Rock, Texas (City) and HDR Engineering, Inc. of Austin, Texas (Engineer). The scope of services to be provided by the Engineer as listed in Attachment B of the Contract has been directly influenced by the following out of scope work items: For the Construction Phase, additional engineering services were required to administer approximately 1,500 feet of 16 -inch pipeline that was installed as part of the 81 -South Elevated Water Storage Tank Project. In addition, additional engineering services were required due to the delay in the property acquisition for the construction of the High Country Elevated Water Storage Tank. Due to the additional work required for the Construction Phase of the 1998/1999 Water Systems Improvements Project, an additional Engineering Fee is required to complete the construction and contract close -out of Contract No. 6 — 81 South Standpipe Demolition and Elevated Water Storage Tank Construction. The scope of engineering services performed by the Engineer for Contract Completion is as follows: 1. Monthly progress meetings, payment applications, project administration services, and miscellaneous expenses for a scheduled final completion of the construction work in August 2002. 2. Review remaining shop drawings and submittals including site work, electrical, paint shrouding plan, demolition plan, and lead compliance plan. 3. Perform project close -out tasks including final walk through, punch list, and administer warranty bonds and other close -out documents. 4. Completion of project As -Built Drawings by October 2002. The above listed services will be completed on a reimbursable, Per Diem basis in the amount not to exceed Ten Thousand Seven Hundred and Fifty Dollars ($10,750.00). The services, as authorized by the City, shall be reimbursed based upon Direct Salary Cost ($ per hour) times an overhead factor of 3.20 for the Engineer. All direct non -labor expenses will be billed at the invoice cost plus ten percent (10 %) service charge. (Note: Billing rates are revised each January to reflect salary increases.) EXHIBIT The term of this Amendment shall commence on the signing date and continue in effect until such time as terminated in writing by either party. We are submitting this proposed Amendment for additional Construction Phase Services that we have provided. As you recall, this contract has covered the Construction Phase Services for several projects including: • Southeast Elevated Pump Station & Site Improvements • Chisholm Valley Standpipe Demolition • Chisholm Valley Elevated Tank Construction • High Country Elevated Tank Construction • 81 South Standpipe Demolition • 81 South Elevated Tank Construction. In addition, we have performed construction Phase Services to administer the construction of a new 16 -inch pipeline as part of the 81 South Tank Project. The contract between the City and HDR for our services on the Lake Creek Pump Station Project was amended to cover the design of this pipeline, but no fee was adjusted for the associated Construction Phase Services. As you well know, this project has been underway for several years, and the schedule for several of the projects has slipped significantly Most notable was the construction of the High Country Elevated Tank, which was delayed 481 days while the City completed acquisition of the required property. During this time, the construction contractor was delayed, and HDR provided additional services to maintain the contractor and negotiation the resulting change orders. It has been our intent to complete the Construction Phase Services for all the projects without exceeding the contractual maximum fee.
