The Round Rock City Council approved the following two Resolutions at
their regularly scheduled meeting on August 8, 2002:
• Resolution No. R- 02- 08- 08 -11G1 which approves Amendment No. 3
for a change in the scope of services concerning the 1998 -1999 Water
System Improvements Project.
• Resolution No. R- 02 -08 -08 -1102 which approves Amendment No. 3
for a change in the scope of services concerning the Lake Creek Pump
Station Improvements Project.
Enclosed are copies of the resolutions and original amendments for your

WHEREAS, the City of Round Rock has previously entered into a
contract for engineering services ( "Contract ") with HDR Engineering,
Inc. for the Lake Creek Pump Station Improvements Project, and
WHEREAS, HDR Engineering, Inc. has submitted Amendment No. 3 to
the Contract for a change in the scope of services, and
WHEREAS, the City Council desires to enter into said Amendment
No. 3 to the Contract for Engineering Services with HDR Engineering,
Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Amendment No. 3 to the Contract with HDR
Engineering, Inc., a copy of said amendment being attached hereto as
Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

AMENDMENT No. 3
To the
CONTRACT FOR ENGINEERING SERVICES between
THE CITY OF ROUND ROCK and
HDR ENGINEERING, INC.
Dated October 14, 1999
GENERAL
This constitutes an Amendment to the Contract for Engineering Services — Lake Creek
Pump Station Improvements Project for PROFESSIONAL SERVICES between the City
of Round Rock "City" and HDR Engineering, Incorporated, of Austin, Texas (HDR).
The scope of services to be provided by the Engineer as listed in Attachment B of the
Contract is amended to include the following:
For the Construction Phase, additional engineering services are required for facilities
added in the design phase under Amendments 1 and 2 and for site conditions unforeseen
or added during construction. The items specifically include the following:
1. Replacement of existing chlorine and ammonia control system and combining all
telemetry at the site into one location for local monitoring and control as well as
communication with the Water Treatment Plant.
2. Adding a new sodium hydroxide storage and feed facility.
3. Modifying existing well collection piping to address hydraulic concerns and
providing for one master flow meter.
4. Modifying existing pump discharge piping to address hydraulic and pipe
condition concerns and providing one master flow meter.
5. Demolishing the existing building housing Well Nos. 1 and 2 and the associated
old chlorine storage and feed facility.
6. Developing a well plugging program for Well Nos. 2, 5, 8 and 10.
7. Providing protection from flooding for Well No. 3.
8. Coordinating asbestos removal and air monitoring.
9. Enclosing the existing chlorine and ammonia feed facilities on three sides to
provide weather protection, including doors on the north side of the building.
10. Adding a new access road from the pump station to Burnet Street with site
lighting and fencing.
11. Providing new fencing around the newly acquired site area that will allow for
future expansion of the pump station facilities.
12. Coordinating overhead power line relocation with TXU.
13. Coordinating and investigating removal requirements for hazardous chemicals
found during site cleanup.
14. Coordinating and investigating site piping and pump can modifications required
due to problems found in the field.
15. Coordinating and investigating replacement of existing chlorine and ammonia gas
detectors, and an existing chlorine controller and actuator.

The additional Construction Phase services required related to the items listed above will
be completed on a Per Diem basis in the amount not to exceed of Thirty Thousand Two
Hundred Dollars ($30,200.00). This amount includes a Per Diem fee of $3,700 for
additional Construction Materials Testing provided by Fugro South, Inc.
The term of this Amendment shall commence on the signing date and continue in effect
until such time as terminated in writing by either party.
The undersigned signatory on signatories for the Engineer hereby represents and warrant
that the signatory is an officer of the organization for which he or she has executed this
Contract and that he or she has full and complete authority to enter into this Contract on
behalf of the firm. The above - stated representations and warranties are made for the
purpose of entering into this Contract with the City.
IN WITNESS HEREOF, the City and the Engineer have executed these presents in
duplicate.

Enclosed please find two original copies of Amendment No. 3 for the above referenced
project. We are submitting this proposed Amendment for additional Construction Phase
Services that we have provided.
As you recall, Ammendment Nos.1 and 2 significantly increased our scope of services for
the design phase by addition of the items listed below.
• A new access road to the site.
• New site lighting.
• Enclosure of the chlorine and ammonia feed facilities.
• Video inspection of four existing wells.
• New fencing around larger plant site.
• Construction of a new sodium hydroxide system storage and feed facility.
• Replacement of the chlorine and ammonia control systems.
• Consolidation of all telemetry at the site into one location.
• Modification of the well collection piping to allow for installation of a new master
meter.
• Modification of the high service pump discharge piping to allow for installation of
a discharge header and a new master meter.
• Demolition of the building housing the existing wells on site.
• Construction of a floodwall at Well #3.
• Testing and preparation of specifications to address the presence of lead based
coatings and asbestos in the facilities to be demolished.
Note that when Amendment Nos. 1 and 2 were finalized, the associated Construction
Phase Services were not adjusted. It was our intent at that time to try and complete the
Construction Phase Services without exceeding the contractual maximum fee. Since
construction began, we have taken great efforts to work within the original fee.
However, the effort required to administer the increased design scope combined with
several unforeseen conditions that have arisen will make this impossible. For your
information, the major unforeseen conditions that have been addressed during
construction include the following:

• The presence of hazardous materials in one structure on the property.
• Replacement of the suction cans on Pumps 1, 2, 3, and 4 due to degradation.
• Changes to site piping due to inaccuracies in the City's record documents.
• Relocation of the redundant radio system from Tower Drive to the 81 South Tank
site.
• The addition of a second chlorine controller and actuator.
• The replacement of existing chlorine and ammonia gas leak detectors.
For your reference, the City Council Resolution authorizing the Contract with HDR is
No. R- 99- 10- 14 -13F1. If the Amendment meets with the City's approval, please return
an executed copy to me for our records.

History: Council approved the current contract with HDR for the Lake Creek Pump Station
Improvements on the 14 day of October 1999 for $167,280.00. These
improvements were needed to replace and upgrade the existing vertical turbine
pumps to deliver water to the 924 pressure plain. Also, council approved Contract
Amendment No. 1 on the 22 day of February 2001, in the amount of
$54,000.00, to consolidate the multiple electric feeds into the site into a single
feed. Additionally, these improvements were to include upgrading the electrical
building, the fluoridation system, and chemical feed system, which will simplify
operations and maintenance. The council approved Contract Amendment No. 2
on the 23 day of August 2001.
The general scope of work under this amendment is for additional service under
the Construction Phase of the Contract due to unforeseen site conditions. These
conditions were the presence of hazardous material, poor condition of four pump
cans, and actual location of site piping did not match record drawings and the
relocation of the redundant radio system from Tower to the South 81 Tank site.
With this Amendment No. 3 the total contract amount will be $301,480.00.
