R-02-08-22-13D1 - 8/22/2002STATE OF TEXAS THE COUNTY OF WILLIAMSON SUPPLEMENTAL AGREEMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Baker - Aicklen & Assoc., Inc., hereinafter called the "Engineer ". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 12 of April 2001 to provide design and survey services related to Historic Downtown Sidewalk and Pedestrian Access Improvements Project. WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires the termination of the Contract on July 31, 2002, unless the Contract is extended, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $131,530.00 without modification of the contract, and WHEREAS, it is the City's best interest to extend the term of the Contract until October 1, 2002 and WHEREAS, it has become necessary to amend the contract to provide for additional services outlined in Addendum No. 1 to Attachment B, and WHEREAS, the Engineer has agreed to provide the additional work performed for $18,355.00 increasing the lump sum fee for the contract to $149,885.00. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD, shall be amended to extend the contract period to October 1, 2002, and ARTICLE 4, COMPENSATION, shall be amended by changing the lump sum amount payable under this contract to $149,885.00. Dobrowolski III, Senior Engineer History: During the process of locating existing utilities for the possible conflicts with underground storm sewer, an active failing waste water line was found. The failing infrastructure was investigated by City Crews and determined there could be total failure in the future. A plan for the replacement of this segment of the collection system was prepared by with Baker - Aicklen & Associates, Inc. In addition, services are required for the unforeseen issues related to the drainage, pavement replacement with minimum closure of Main Street, safety railing on steps, and coordination not in the original scope of Professional Services Contract. Estimate cost of the increase scope of service is $18,355.00. Staff recommends approval. Funding: Cost: $18,355.00 Source of funds: General self financed construction, 2000 CO, & self finance wastewater utility funds Outside Resources: Baker — Aicklen & Associates, Inc.
