The Round Rock City Council approved Resolution No.■- 02- 11 -14-
- 13B9 at their regularly scheduled meeting on November 14, 2002. This
resolution approves a Letter of Agreement for the relocation of a three
inch gas line at Harris Street and Bagdad Street.
Enclosed is a copy of the resolution and agreement for your files. If

RESOLUTION NO. R- 02- 11- 14 -13B9
WHEREAS, the City of Round Rock ( "City ") is planning to construct
a Senior Activity Center on City property at the Municipal Office
Complex, and
WHEREAS, a three inch gas line located on the property at Harris
Street and Bagdad Street must be relocated prior to the construction of
the Senior Activity Center, and
WHEREAS, the City and TXU Gas Company wish to enter into a Letter
of Agreement for the relocation of said gas line, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a Letter of Agreement with TXU Gas Company for the
relocation of a three inch gas line at Harris Street and Bagdad Street,
a copy of same being attached hereto as Exhibit "A" and incorporated
herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

Dear Mr. Madson:
City of Round Rock ( "Customer ") has requested that TXU Gas Company ( "Company ") provide relocation
of a 3 inch gas main at the above referenced location.
Customer is responsible for $14,287.00 as payment for the Customer's cost of said relocation,
such payment to be and remain the property of the Company. Customer's payment in full is due at the time
this agreement is returned to Company.
Company at all times shall have title to and complete ownership and control over said facilities.
Customer is responsible for providing, without cost to the Company: (1) suitable space on
Customer's premises for the installation of the facilities; and (2) rough site grading to final grade along the
route of the facilities and clearing the area of all obstructions.
This agreement supersedes all previous agreements or representation, either written or oral,
between Company and Customer made with respect to the matters herein contained, and when duly
executed constitutes the agreement between the parties hereto and is not binding upon Company unless and
until signed by one of its duly authorized representatives.
This agreement and the costs set forth therein, if not accepted within 30 days of the date of this
letter, will be of no force and effect. Acceptance shall consist of delivery of an executed copy of this
agreement to Company along with Customer's payment as set forth above.

The current gas line lies in an easement on city property that the new
Senior Activity Center will be built upon. The City plans to abandon this
easement and relocate gas line along the far west property line of the
Municipal Office Complex. TXU will relocate the line for $14,287.00

Dear Bob,
The city will have to have a gas line relocated on the MOC site at Bagdad & Brown to eventually
build the Senior Activity Center. We had budgeted $30,000 to do this project but in negotiating
with TXU Gas Company for the relocation they have agreed to relocate the line along the
property line for $14,287.00.
We would lice to get this done at this time and I am requesting your signature on the LOA.
