R- 02- 12- 05 -8C1 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with WHM Transportation Engineering Consultants, Inc. for the design of traffic signals at the intersection of Creekbend Boulevard and FM 3406, and WHEREAS, WHM Transportation Engineering Consultants, Inc. has submitted Supplemental Agreement No. 1 to the Contract for Engineering Services for a change in the scope of services, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 with WHM Transportation Engineering Consultants, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Contract for Engineering Services with WHM Transportation Engineering Consultants, Inc., a copy of said Supplemental Agreement No. 1 being attached hereto as Exhibit "A" and incorporated herein. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. MARTINEZ, City Secre 2 WELL, Mayor ity of Round Rock, Texas STATE OF TEXAS § THE COUNTY OF WILLIAMSON § SUPPLEMENTAL AGREEMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and WHM Transportation Engineering Consultants, Inc., hereinafter called the "Engineer ". - WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 11 of July, 2002 to provide professional traffic engineering services in preparation of a traffic signal design for the intersection of FM 3406 and Creekbend Boulevard, and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $10,500.00 without modification of the contract, and WHEREAS, it has become necessary to amend the contract to provide for additional work to include completing and submitting a signal warrant study to the Texas Department of Transportation, obtaining and reviewing accident data from the Department of Public Safety and the Round Rock Police Department, and completing and submitting an additional signal warrant study containing an accident analysis to TxDOT, and WHEREAS, the Engineer has agreed to have the additional work performed for $2,200.00 increasing the lump sum fee for the contract to $12,700.00. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 4, COMPENSATION, shall be amended by the changing the lump sum amount payable under this contract as $12,700.00. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 1 with WHM Transportation Consultants, Inc. for the design of traffic signals at the intersection of Creekbend Boulevard and FM 3406. Resource: Chief of Operations /Assistant City Manager Tom Word, Director of Transportation Services History: Preliminary traffic studies had indicated that Creekbend Boulevard and FM 3406 met traffic signal warrants. Since the original contract, WHM Transportation Engineering Consultants, Inc., has completed Stage 1 work which involved preparing a traffic signal warrant analysis for the proposed traffic signal installation. After the Texas Department of Transportation reviewed the warrant study, and determined that a signal was not warranted, WHM proceeded to Stage 2. Stage 2 at a cost of $2,200 would include additional work of (1) completing and submitting a signal warrant study to the Texas Department of Transportation; (2) obtaining and reviewing accident data from the Department of Public Safety and the Round Rock Police Department; and (3) completing and submitting an additional signal warrant study containing an accident analysis to TxDOT.
